These Regulations amend the Energy Performance of Buildings (Scotland) Regulations 2008 (“the 2008 Regulations”). The 2008 Regulations require the production of energy performance certificates when buildings are to be sold or rented out.

This Order amends Class A (electronic communications code operators) of Part 16 of Schedule 2 to the Town and Country Planning (General Permitted Development) (England) Order 2015 (“the GPDO”). The GPDO provides, for the purposes of section 59 of the Town and Country Planning Act 1990 (c. 8), for the granting of permission for certain classes of development without the requirement for a planning application to be made under Part 3 of that Act. The classes of permission, together with their accompanying conditions, limitations and restrictions, are set out in Schedule 2 to the GPDO.

Regulation 2 of these Regulations introduces the Schedule. Part 1 of the Schedule amends the Building Regulations 2010 (S.I. 2010/2214), as they apply in England, so as to impose (in the new paragraphs RA1 and RA2 inserted in Schedule 1 to those Regulations by paragraph 8 of the Schedule) new requirements relating to the provision, in relation to newly built dwellings, of “gigabit-ready physical infrastructure” and a connection to a “gigabit-capable public electronic communications network” (those terms being defined in regulation 44C of those Regulations as amended by paragraph 6 of the Schedule).
