Scottish Statutory Instrument
These Regulations make provision in connection with the preparation and content of schemes of delegation under section 43A(1) of the Town and Country Planning (Scotland) Act 1997 (c.8) (“the Act”) and the procedure for reviews held by virtue of section 43A(8) of the Act. They replace and revoke the Town and Country Planning (Schemes of Delegation and Local Review Procedure) (Scotland) Regulations 2008.

Section 108 of the Town and Country Planning Act 1990 provides for the payment of compensation in certain cases where planning permission for development granted by a development order or a local development order is withdrawn and where on an application for planning permission for that development, the application is refused.

These Regulations replace on 1st April 1994 the Local Government (Direct Labour Organisations) (Competition) Regulations 1989 so far as they apply to local authorities in Wales. This is in recognition of the additional administrative work which local government reorganisation in Wales will place upon Welsh local authorities.

Scottish Statutory Instrument
These Regulations amend the Town and Country Planning (Fees for Applications and Deemed Applications) (Scotland) Regulations 2004. They introduce a new category of fee for applications for planning permission for construction of hydro-electric generating stations and connected operations of £401 per 0.1 hectare, subject to a maximum of £20,055.

These Regulations replace on 1st July 1997 the Local Government, Planning and Land Act 1980 (Competition) (Scotland) Regulations 1995, as amended, by changing the levels above which certain services provided by local authorities require to be exposed to competitive tender. The 1995 Regulations, which required less work to be exposed to competitive tender than had previously been the case, were enacted in recognition of the additional administrative work which local government reorganisation placed upon local authorities.

These Regulations replace on 31st March 1995 the Local Government (Direct Labour Organisations) (Competition) (Scotland) Regulations 1990 (S.I. 1990/1782) as amended, by raising the level above which certain services provided by local authorities and development corporations require to be exposed to competitive tender. This is in recognition of the additional administrative work which local government reorganisation will place upon local authorities and in recognition of the winding-up of development corporations in Scotland.
