Scottish Statutory Instrument
These Regulations amend the Town and Country Planning (Development Management Procedure) (Scotland) Regulations 2008. Regulation 2(2) inserts a definition of “historic battlefield”. This relates to the new inventory of historic battlefields compiled and maintained under section 32B of the Ancient Monuments and Archaeological Areas Act 1979. Regulation2(3) introduces a requirement upon the planning authority to consult the Scottish Ministers in certain cases where an application for planning permission is made for development which may affect a historic battlefield. In terms of regulation 1(2) the requirement to consult applies only to applications for planning permission made on or after 1st August 2012.

These Regulations, which apply to England only, apply where the Secretary of State is authorised to recover costs borne by him in connection with unitary development plan, local plan or simplified planning zone inquiries or other hearings or examinations in public in respect of structure plans (“qualifying inquiries”).

This Order amends the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 to provide that permitted development rights may only be exercised in relation to an existing use or building if the existing use or the building operations in respect of the construction of the existing building are lawful.

This Order amends the Town and Country Planning (General Permitted Development) Order 1995. Part 3 of Schedule 2 to that Order grants planning permission for certain changes of use by reference to classes of use specified in the Town and Country Planning (Use Classes) Order 1987 SI 1987 No.764. That Order is amended by the Town and Country Planning (Use Classes) (Amendment) (England) Order 2005 which substitutes for the former class A3 (food and drink), three new use classes: restaurants and cafes (A3), drinking establishments (A4) and hot food takeaways (A5).

This Order consolidates with amendments the Town and Country Planning General Development Order 1977 and subsequent amending instruments, except the provisions relating to planning applications which are reproduced in the Town and Country Planning (Applications) Regulations 1988 (S.I. 1988/1812). The consolidation also incorporates the provision previously made by the special development orders listed in Schedule 7.

This Order amends Class V (Agricultural buildings, works and uses) of Schedule 1 to the Town and Country Planning (General Development) (Scotland) Order 1981 to remove from permitted development (a) buildings of more than 465 square metres which are used to house pigs, poultry, rabbits or animals bred for their skin or fur, and (b) any structures associated with such buildings and used for storing slurry or sewage sludge. A definition of “slurry” is inserted into article 2 of the 1981 Order.

These Regulations amend the Town and Country Planning (Environmental Impact Assessment)(England and Wales) Regulations 1999 in respect of England only, though regulation 22 inserts provisions that also apply in relation to Scotland, Wales and Northern Ireland.

These Regulations, which apply in England only, apply in relation to any person who is after 23rd May 2003 appointed to conduct, or is appointed as one of the persons who are to conduct, an examination in public under section 35B(1) of the Town and Country Planning Act 1990 and whose remuneration, and travelling or subsistence allowances (if any), in respect of the appointment are to be paid by the local planning authority.
