The Town and Country Planning (General Development Procedure) Order 1995 (“the 1995 Order”) specifies the procedures connected with planning applications, appeals to the Secretary of State and related matters so far as these are not laid down in the Town and Country Planning Act 1990. This Order amends the 1995 Order in relation to England.

This Order brings into force on 6th April 1992 the following provisions of the Planning and Compensation Act 1991—section 19 (receipt and determination of applications) so far as not yet in force;section 24 (advertisements);section 32 (planning: minor and consequential amendments) so far as that section relates to paragraph 38 of Schedule 7 to the 1991 Act and to paragraph 53(3) of that Schedule to the extent that the latter concerns applications for consent to the display of advertisements; andsection 84(6) (repeals), so far as it gives effect to the repeal, in Part I of Schedule 19, of paragraph 4(1) of Schedule 1 to the 1990 Act, so far as that repeal is not already in force.

This Order brings into force on two different dates section 57 of the Planning and Compensation Act 1991 insofar as it relates to paragraphs 3 and 9 and paragraph 11 of Schedule 10 to that Act. The Order applies only to Scotland. Paragraphs 3, 9 and 11 of Schedule 10 effect amendments to and insertions in the Town and Country Planning (Scotland) Act 1972.
