These Regulations implement in England and Wales articles 7 (energy performance certificates), 9 (air-conditioning system inspections) and 10 (energy assessors) of the Energy Performance of Buildings Directive, OJ No L 1, 4.1.2004 (“the Directive”) which lays down requirements for the production of energy performance certificates when buildings are constructed, sold or rented out, display of certificates in large public buildings, and regular inspections of air-conditioning systems.

These Regulations amend the Energy Performance of Buildings (England and Wales) Regulations 2012 (S.I. 2012/3118) (“the principal regulations”), which implemented Directive 2010/31/EU of the European Parliament and of the Council on the energy performance of buildings (recast) (OJ No L 153, 18 18.6.2010, p. 13). The principal regulations were made in exercise of the powers conferred by section 2(2) of the European Communities Act 1972. That Act was repealed by section 1 of the European Union (Withdrawal) Act 2018 but the principal regulations continue to have effect as retained EU law by virtue of section 2 of the European Union (Withdrawal) Act 2018.

These Regulations further amend the Building Regulations 1991 (S.I. 1991/2768) to substitute a revised Regulation 7, which is set out in Regulation 4 of these Regulations. The revised Regulation 7 retains the obligation to carry out building work using materials which are appropriate to the particular circumstances which apply, and for those materials to be used in a workmanlike manner. In addition, it provides that materials used in building work must be adequately mixed or prepared, and that they must be used so as adequately to perform the functions for which they are designed. The revised Regulation 7 no longer refers to forms of product approval: guidance on materials and workmanship is given in the approved document referred to below.

Northern Ireland Statutory Rule
These Regulations amend the Planning (Fees) Regulations (Northern Ireland) 2005 which prescribe fees payable to the Department of the Environment in respect of applications made under the Planning (Northern Ireland) Order 1991. The Regulations increase planning fees by approximately 15% overall and make certain minor amendments to the wording of regulation 14.

The Planning (Environmental Impact Assessment) Regulations (Northern Ireland) 1999 (“the 1999 Regulations”) implemented, for Northern Ireland, Council Directive 85/337/EEC (“the EIA Directive”) on the assessment of the effects of certain public and private projects on the environment (O.J. No. L175, 5.7.1985, p.40) as amended by Council Directive 97/11/EC (O.J. No. L73, 14.3.1997, p.5). The EIA Directive was also amended by Council Directive 2003/35/EC (O.J. No. L156, 25.6.2003, p.17).
