Welsh Statutory Instrument
Section 321 of the Town and Country Planning Act 1990 (“the 1990 Act”) provides that all planning inquiries are to be held in public except to the extent where, in relation to land in Wales, the National Assembly for Wales (“the National Assembly”) or the Secretary of State otherwise direct that it would be contrary to national security on the grounds of national interest or the security of premises or property.

Scottish Statutory Instrument
This Order amends the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 (“the 1992 Order”) to introduce new class 72D which provides permitted development rights for temporary development by the Crown in relation to the prevention, control and mitigation of a pandemic. The Order also extends the duration of planning permission under class 91 from 6 to 18 months where temporary development relates to the prevention, control or mitigation of a pandemic.

These Regulations implement, as respects Great Britain, Council Directive No. 85/610/EEC (OJ No. L375, 31.12.85, p.1) which amends Council Directive No. 76/769/EEC (OJ No. L262, 27.9.76, p.201) on the marketing and use of asbestos. They do so by amending the Asbestos (Prohibitions) Regulations 1985 (S.I. 1985/910).

These Regulations amend the Health and Safety (Training for Employment) Regulations 1988 which give to certain trainees who are not employees the protection for and duties of employees under the relevant statutory provisions as defined in the Health and Safety at Work etc. Act 1974. The 1988 Regulations apply to training provided pursuant to arrangements made under section 2 of the Employment and Training Act 1973 (c. 50) and known by any of the names specified in the Schedule to those Regulations.

Section 265A of the Town and Country Planning (Scotland) Act 1997 provides that all planning inquiries are to be held in public except where the Secretary of State or the Scottish Ministers, after consultation with the Secretary of State, otherwise direct on the grounds of national security. Section 265A also makes provision for the appointment of persons (“appointed representatives”) to represent the interests of any person who will be prevented from hearing or inspecting any evidence at a local inquiry if such a direction is given.

Scottish Statutory Instrument
This Order brings all the provisions of the Flood Risk Management (Scotland) Act 2009 into force on 26th November 2009, except section42 (amendment to planning regulations) and Parts 4 (local authority powers to manage flood risk), 6 (powers of entry and compensation) insofar as it relates to Part 4, and 7 (reservoirs). The Act received Royal Assent on 16th June 2009 and Part 2 (sections 3 to 6) and sections 55, 71, 94, 95 and 97 came into force on that day.

Welsh Statutory Instrument
This Order brings the remaining provisions of Part 6 of the Planning and Compulsory Purchase Act 2004 (“the Act”) into force on 15 October 2005, namely sections 61, 64 to 71, 74 and 76 (in so far as it is not already in force), with the exception of the regulation-making provisions within those sections, which will come into force on 5 October 2005.
