Northern Ireland Statutory Rule
These Regulations implement in relation to planning in Northern Ireland, Article 30 of Directive 2012/18/EU (O.J. L.197, 24.7.2012, p.1) (“the Seveso III Directive”) on the control of major-accident hazards involving dangerous substances, amending Council Directive 96/82/EC (O.J. L 10, 14.1.1997, p13) (“the Seveso II Directive”).

Northern Ireland Statutory Rule
These Regulations make provision for the new development management processes for determining planning applications. The statutory rule puts in place the regulatory framework required to implement the development management provisions in Part 3 of the Planning Act (Northern Ireland) 2011 (“the 2011 Act”).

These Regulations amend the Infrastructure Planning (Environmental Impact Assessment) Regulations 2009 (“the 2009 Regulations”). Under section 71 of the Control of Pollution Act 1974, the Secretary of State may give guidance on appropriate methods for minimising noise (which, pursuant to section 73 of that Act, includes vibration) by approving codes of practice. The Secretary of State is required to approve a code for the carrying out of works to which section 60 of the Act applies. Section 60 applies to construction works, which include building and road works, demolition, dredging and other works of engineering construction.
