Northern Ireland Statutory Rule
Part 2 of the Planning Act (Northern Ireland) 2011 (the 2011 Act) establishes a new system of local development planning in Northern Ireland. These Regulations make provision for the operation of that system.

These Regulations amend the Town and Country Planning (Local Development) (England) Regulations 2004 (“the 2004 Regulations”) which make provision in connection with the system of local development planning established by Part 2 of the Planning and Compulsory Purchase Act 2004 (“the 2004 Act”). Since the 2004 Regulations apply in relation to England only, the amendments made by these Regulations similarly only apply in relation to England.

Northern Ireland Statutory Rule
These Regulations implement in relation to planning in Northern Ireland, Article 30 of Directive 2012/18/EU (O.J. L.197, 24.7.2012, p.1) (“the Seveso III Directive”) on the control of major-accident hazards involving dangerous substances, amending Council Directive 96/82/EC (O.J. L 10, 14.1.1997, p13) (“the Seveso II Directive”).

The Town and Country Planning (General Development Procedure) Order 1995 (“the 1995 Order”) specifies the procedures connected with planning applications, appeals to the Secretary of State and related matters so far as these are not laid down in the Town and Country Planning Act 1990 (“the 1990 Act”) and the Town and Country Planning (Applications) Regulations 1988 (S.I. 1988/1812). It also deals with the maintenance of registers of planning applications, applications for certificates of lawful use or development, and other related matters. This Order amends the 1995 Order.

United Kingdom Statutory Instrument
This Order amends Parts 1 and 25 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (“the 1995 Order”). These Parts confer permitted development rights in respect of the erection of satellite and microwave antenna (as defined in article 1(2) of the Order). The amendments apply in relation to England.

Northern Ireland Statutory Rule
These Regulations make provision for the new development management processes for determining planning applications. The statutory rule puts in place the regulatory framework required to implement the development management provisions in Part 3 of the Planning Act (Northern Ireland) 2011 (“the 2011 Act”).

Under section 71 of the Control of Pollution Act 1974, the Secretary of State may give guidance on appropriate methods for minimising noise (which, pursuant to section 73 of that Act, includes vibration) by approving codes of practice. The Secretary of State is required to approve a code for the carrying out of works to which section 60 of the Act applies. Section 60 applies to construction works, which include building and road works, demolition, dredging and other works of engineering construction.
