Northern Ireland Statutory Rule
The Protocol on Ireland / Northern Ireland in the Withdrawal Agreement (“the Protocol”) requires that the EU legislation listed in Annex 2 to that Protocol is implemented in Northern Ireland. Annex 2 includes Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products (“the Biocides Regulation”; OJ No. L167, 27.06.12, p.1) and Regulation (EC) No. 1272/2008 of the European Parliament and of the Council of 16 December 2008 on classification, labelling and packaging of substances and mixtures (“the CLP Regulation”; OJ No. L353, 31.12.08, p.1).

These Regulations impose requirements with respect to the control of major accident hazards involving dangerous substances. The expressions “major accident” and “dangerous substances” are defined in regulation 2(1). The Regulations implement Directive 2012/18/EU of the European Parliament and of the Council on the control of major accident hazards involving dangerous substances, amending and subsequently repealing Council Directive 96/82/EC (OJ L 10, 14.1.1997, p. 13) (the “Seveso III Directive”), except for Articles 13 and 15, which relate to land use planning, and Article 30, which was implemented by the Heavy Fuel Oil (Amendment) Regulations 2014 (S.I. 2014/162).

United Kingdom Statutory Instrument
This Order authorises the undertaker (referred to in this Order as the undertaker) to construct, operate and maintain a power generating station and carbon capture and compression plant. The Order permits the undertaker to acquire, compulsorily or by agreement, land and rights in land and to use land for this purpose.

This Order appoints the day on which the access preparation period ends in relation to land which is coastal margin as a result of the approval, by the Secretary of State, of Natural England’s proposals contained in reports relating to coastal access upon the long-distance route around the Isle of Sheppey. These Regulations amend the Personal Protective Equipment at Work Regulations (Northern Ireland) 1993 (“the PPER 1993”) to extend the duties contained in regulations 4 to 11 of the PPER 1993 from employees to workers, and to update cross-references to other legislation.

These Regulations are made in exercise of the powers conferred by section 8(1), and paragraph 21 of Schedule 7 to, the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(a) and (g)) arising from the withdrawal of the United Kingdom from the European Union. The amendments are made to legislation governing environmental impact assessment for highway schemes of the Secretary of State, the Welsh Ministers and Highways England via regulation 3, and for harbour schemes via regulation 2.

This Order amends the Air Navigation Order 2000 (“the ANO”). In addition to minor and drafting amendments the following changes are made:The CAA or an authorised person may require production of any documents and records relating to approved air traffic service equipment (article 4).In respect of UK airspace and outside the UK for which the UK provides air navigation services an air traffic control approval granted by the CAA is required, which may be granted subject to such conditions as the CAA thinks fit and shall remain in force for the period specified on it (article 5 provides substitute article 88 of the ANO).The CAA may, in the interests of safety, direct the holder of a licence to provide air traffic services granted under Part I of the Transport Act 2000 to provide such air traffic control service, flight information service or means of two way radiocommunication as the CAA considers appropriate (article 7 inserts article 90A of the ANO).The CAA may, in the interests of ensuring the efficient use of airspace so as to require that air traffic services are provided to a standard appropriate for the airspace classification, direct any person in charge of the provision of air traffic services to provide such services as the CAA considers appropriate (article 7 inserts article 90B of the ANO).Air traffic service equipment is defined to mean ground based equipment including an aeronautical radio station, used or intended to be used in connection with the provision of a service to an aircraft in flight or on the ground. Such equipment may not be established or used unless the CAA has approved its intended purpose, the competence of the person in charge and the equipment. Records must be kept in relation to such equipment and associated recording apparatus in accordance with specified requirements. If required recording apparatus becomes unserviceable, the person in charge of the air traffic service equipment must render it serviceable again as soon as reasonably practicable (article 9 provides substitute articles 104 and 105 of the ANO and inserts Schedule 15 into the ANO).The CAA and authorised persons have the right of access to any building or place from which an air traffic control service is being provided or where any approved air traffic service equipment is situated (article 10 amends article 119 of the ANO).Various definitions are provided for and in particular an air traffic direction is defined as a direction made under article 90A and an airspace policy direction is defined as a direction made under article 90B (article 11 amends article 129 of the ANO).Co-pilots of helicopters flying on scheduled journeys for public transport in instrument meteorological conditions must hold an instrument rating (article 12 amends Schedule 8 of the ANO).
