These Regulations amend the procedures contained in Part VA of the Highways Act 1980, (“the Act”), for the environmental impact assessment of projects for the construction or improvement of highways for which in England the Secretary of State and in Wales the National Assembly for Wales (“the authorities”) are respectively the highway authority, (i.e. these highways are for the most part trunk roads).

This Order exempts those who acquire control, an additional kind of control or an increase in a relevant kind of control over authorised building societies (as defined in article 1) from the obligation imposed under Part XII of the Financial Services and Markets Act 2000 to notify the Financial Services Authority of that change of control. The exemptions do not apply if the person is acquiring or increasing holdings of a specified percentage of the capital (as defined in article 1) of such a society. Article 3 exempts those who reduce their control over authorised building societies. The exemptions do not apply if the person is reducing his holding of the capital of such a society by a specified percentage.

Chapter 8 of Part 2 of the Energy Act 2013 (c 32)(“the Act”) imposes a duty “the emissions limit duty” on operators of fossil fuel plant granted planning consent on or after 18th February 2014, to ensure that its annual emissions of carbon dioxide attributable to fossil fuels do not exceed an amount (“the emissions limit”) determined according to a formula set out in section 57(2) of the Act.

This Order overrides restrictions contained in the Humber Conservancy Acts 1899 and 1905 in their application to a proposed development by Humber Power Limited for the construction of cooling works comprising conduits with an intake or intakes and an outfall or outfalls in the River Humber for the purpose of a combined cycle gas turbine generating station which the Company proposes to construct adjacent to the river in the borough of Cleethorpes.

These Regulations, which apply to Great Britain, amend the Health and Safety (Emissions into the Atmosphere) Regulations 1983, to take account of Council Directive 84/360/EEC (O.J. No. L188, 16.7.84, p.20) on the combating of air pollution from industrial plants and Council Directive 87/217/EEC (O.J. No. L85, 28.3.87, p.40) on the prevention and reduction of environmental pollution by asbestos, and make certain other provisions for the control of air pollution. Plants belonging to the categories listed in Annex I to Council Directive 84/360/EEC, and certain other plants, which were not previously subject to air pollution control under the provisions of Part I of the Health and Safety at Work etc. Act 1974 (c. 37) are, by these Regulations, made subject to such control.
