Part 2 of the Regulations amends the Building Regulations 2010 (“the 2010 Regulations”) to insert provisions relating to target fabric energy efficiency (“TFEE”) rates and new dwellings. Regulation 4 amends regulation 25 of the 2010 Regulations requiring the Secretary of State to approve TFEE rates; regulation 5 inserts regulation 26A requiring that new dwellings must not exceed the TFEE rate; regulation 6 inserts regulation 27A setting out the procedure to be followed by the person carrying out the work to submit evidence regarding the TFEE rates to the local authority; regulation 8 inserts a definition of fabric energy efficiency into regulation 35 of the 2010 Regulations and regulation 9 sets out the transitional provisions for the amendments to the 2010 Regulations

TheSelf-build and Custom Housebuilding Act 2015 (c 17)(“the Act”) requires relevant authorities to keep a register of individuals and associations of individuals who are seeking to acquire serviced plots of land in the authority’s area and, unless exempt, to grant sufficient development permissions to meet the demand for self-build and custom housebuilding. These Regulations are made under sections 2B and 5 of, and the Schedule to, the Act and make provision in relation to the definition of a serviced plot of land, registers kept under the Act and exemption from the duty.

Northern Ireland Assembly Measure
Part II of this Order makes miscellaneous amendments to the Planning (Northern Ireland) Order 1972 and related enactments. The principal amendments are to revise the procedure for making development plans, to provide for simplified planning zones, to confer on the Department of the Environment new powers to require planning applications to be made, to issue discontinuance orders and to enter into planning agreements with developers, to provide for the control of hazardous substances and to provide for the application, with certain modifications, of the planning enactments to Crown land.

These Regulations amend the Building Regulations 1985. The principal amendments (regulation 2(4) and the Schedule) are the substitution of new Parts, with changed requirements, for Parts F (Ventilation), G (Hygiene), H (Drainage and Waste Disposal), and L (Conservation of Fuel and Power) in Schedule 1 to the 1985 Regulations. Regulation 2(5) amends regulation 11 of the 1985 Regulations to remove the requirement to give a building notice or deposit full plans in certain defined circumstances where the work consists only of the installation of a hot water supply system. Consequential amendments are made to the Building (Approved Inspectors etc) Regulations 1985. Regulation 4 contains transitional provisions.
