Section 3(2) of the Health and Safety at Work etc. Act 1974 (“the 1974 Act”) was amended by the Deregulation Act 2015 (c. 20) to limit the scope of the general duty under that section. Only those self-employed persons who conduct undertakings of a prescribed description will have an obligation to conduct their undertaking in such a way as to ensure that, so far as is reasonably practicable, they themselves and other persons who may be affected thereby are not exposed to risks to their health and safety.

These Regulations specify the circumstances in which self-employed persons will be required to comply with their duty under section 3(2) of the Health and Safety at Work etc. Act 1974 (“the 1974 Act”) to conduct their undertakings in such a way as to ensure, so far as reasonably practicable, that they themselves and other persons (not being their employees) who may be affected by their work activities are not exposed to risks to their health and safety. Every self-employed person continues to hold a duty in respect of their employees under section 2 of the 1974 Act.

The Control of Major Accident Hazards Regulations 2015 (S.I. 2015/483) (“the 2015 Regulations”) implemented Directive 2012/18/EU of the European Parliament and of the Council on the control of major accident hazards involving dangerous substances, amending and subsequently repealing Council Directive 96/98/EC (O.J. No. L 197, 24.7.2012, p.1) (“the Seveso III Directive”).

Part 1 of the Infrastructure Act 2015 (c. 7) makes provision for the Secretary of State to appoint a strategic highways company to act as the highway authority in respect of the areas and highways specified in the appointment. As a consequence of its appointment a strategic highways company will exercise certain statutory powers and functions under highways-related and other legislation.

This Order varies the Health and Safety at Work etc. Act 1974 (Application outside Great Britain) Order 2001 (“the 2001 Order”), which applies sections 1 to 59 and 80 to 82 of the Health and Safety at Work etc. Act 1974 (“the prescribed provisions”) to certain premises and activities in the territorial sea adjacent to Great Britain and beyond the territorial sea to areas designated by order under section 1(7) of the Continental Shelf Act 1964.

The Health and Safety at Work etc. Act 1974 (Application to Environmentally Hazardous Substances) Regulations 2002 (“the 2002 Regulations”) extend the reference to dangerous substances in section 1(1)(c) of the Health and Safety at Work etc. Act 1974 (“the 1974 Act”) to include environmentally hazardous substances for the purpose of enabling Regulations to be made under section 15 of the 1974 Act to implement the Directives referred to in regulation 2 of the 2002 Regulations.

These Regulations amend the allocation of responsibility for the enforcement of health and safety law in respect of railways, tramways and other guided transport systems between the Office of Rail Regulation (“ORR”) and the Health and Safety Executive (“HSE”) by amending the Health and Safety (Enforcing Authority for Railways and other Guided Transport Systems) Regulations 2006 (“the 2006 Regulations”).

These Regulations amend the Health and Safety Information for Employees Regulations 1989 (1989 No. 682), which require information relating to health, safety and welfare to be furnished to employees by means of posters or leaflets in the form approved and published for the purposes of the Regulations by the Health and Safety Executive.

Section 31A(1) of the Highways Act 1980 (“the 1980 Act”) requires the appropriate council, as defined in section 31(7) of the 1980 Act, to keep a register containing information relating to maps and statements deposited and declarations lodged with that council, under section 31(6) of the 1980 Act, relating to dedicated highways.
