Scottish Statutory Instrument
Section 93 of the Planning and Compulsory Purchase Act 2004 amended the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 by inserting new section 73B. This section makes provision for urgent applications for works to buildings on Crown land which are listed or which are in conservation areas and provides for such applications to be made directly to the Scottish Ministers.

Scottish Statutory Instrument
These Regulations which are made under sections 1, 3(3), 8(8), 54, 56 of, and Schedule 1 to, the Building (Scotland) Act 2003 prescribe functional standards for buildings. These are to be found in Schedule 5 of these Regulations and cover a wide subject area. They are part of the reform of the building standards system as set out in the Building (Scotland) Act 2003.

These Regulations further amend the Building (Procedure) (Scotland) Regulations 1981 to:increase building control fees. This is done in 2 stages with effect from 24th July 1995 and 24th July 1996, by an average of 20% and 15% respectively. The lowest operations cost threshold has been increased to £2,000 from 24th July 1995 and to £3,000 from 24th July 1996. The regulations also make it clear that the estimated cost on which fees are calculated should not include an element for the VAT which may be payable when the works are carried out; andmake other minor amendments to reflect recent changes in the building standards regulations.

These Regulations, which apply to England and Wales, amend the Building Regulations 2010 (S.I. 2010/2214) (“the Building Regulations”) and the Energy Performance of Buildings (England and Wales) Regulations 2012 (S.I. 2012/3118) (“the Energy Performance of Buildings Regulations”) in connection with the green deal energy efficiency scheme (“the green deal scheme”) created by Chapter 1 of Part 1 of the Energy Act 2011 (c.16.) (“the Act”).

Regulation 3 of the Planning (Listed Buildings and Conservation Areas) Regulations 1990 (“the 1990 Regulations”) makes provision for applications made to local planning authorities for listed building consent or conservation area consent. Regulation 2(2) of these Regulations amends regulation 3 of the 1990 Regulations to provide for applications to be made on a form published by the Secretary of State and to specify what constitutes a valid application. A minor change is also made to the period within which the local planning authority must give their decision, so that it now starts the day after a valid application is received rather than the day it is received.

These Regulations, which apply in England only, amend the Planning (Listed Buildings and Conservation Areas) Regulations 1990. The changes are the introduction of a requirement for the local planning authority to provide a summary of the reasons for a grant of listed building consent or conservation area consent where no conditions are attached to such consent (regulation 2) and an amendment altering the time limit for appeals from six to three months (regulations 4 and 5). The Regulations make one other consequential change and include transitional provisions.
