These Regulations replace the scale of building control fees in the Building (Procedure) (Scotland) Regulations 1981. The average increase is approximately one-third. Demolition warrant fees are now included in paragraph 1(a) of the table of fees and are charged on a sliding scale rather than at a fixed rate, as was previously the case. In addition, a fixed fee is now payable in respect of all applications for extension of a period of a warrant, not only in respect of those applications relating to limited life buildings.

These Regulations amend the Planning (Listed Buildings and Conservation Areas) Regulations 1990. Most of the amendments are consequential on amendments and repeals in the Planning and Compulsory Purchase Act 2004. They insert publicity requirements for applications for planning permission for development which the local planning authority think will affect the setting of a listed building, or the character or appearance of a conservation area.
