These Regulations bring into force sections 64, 65, 67, 68 and 145(5) of the Housing and Planning Act 2016 (c.22) on 26th May 2016. Section 64 enables the Secretary of State to make a payment to a private registered provider (as defined in section 68) in respect of the discount awarded to a tenant of that provider when buying their home under the voluntary right to buy. Section 65 allows the Greater London Authority to make equivalent payments in respect of dwellings in Greater London. Section 67 makes consequential amendments and section 68 provides for the interpretation of Part 4, Chapter 1 of the Act in which the substantive provisions to be commenced appear. Section 145(5) inserts a new section 21A of the Planning and Compulsory Purchase Act 2004 (c. 5) to enable the Secretary of State to direct a local planning authority not to take any step in connection with the adoption of a development plan document pending possible use of other intervention powers.

This Order amends, in England, Part 3 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (S.I. 1995/418). Part 3 sets out permitted development rights in relation to certain changes of use, the effect of which is that those changes of use are granted planning permission without the need for a planning application.

These Regulations amend the Town and Country Planning (Fees for Applications and Deemed Applications) (Scotland) Regulations 1990 (“the principal Regulations”), which make provision for the payment of fees to planning authorities in respect of—applications made under Part III of the Town and Country Planning (Scotland) Act 1972 for planning permission for development or for approval of matters reserved by an outline planning permission and in respect of applications for consent for the display of advertisements;applications for planning permission which are deemed to have been made, by virtue of the provisions of section 85(7) of the 1972 Act, in connection with an appeal against an enforcement notice; andapplications for certificates of lawful use or development made under sections 90 and 90A of the 1972 Act.

Article 2 of this Order brings into force on 9th November 1992 the following provisions of the Planning and Compensation Act 1991—section 12(1) (planning obligations), so far as it is not yet in force;section 32 (planning: minor and consequential amendments), in so far as it relates to paragraphs 9(2)(d) (so far as that paragraph is not yet in force), 53(5) (local planning authorities: distribution of functions) (so far as that paragraph is not yet in force), 54(2), (3)(b) and (f) and 57(2)(f) (planning obligations); andsection 84(6) (repeals) and Schedule 19 in so far as they relate to repeals in Part I of Schedule 19 specified in the Schedule to this Order.

This Order amends the Town and Country Planning (Use Classes) (Scotland) Order 1989 (“the principal Order”). The principal Order specifies classes for the purposes of section 19(2)(f) of the Town and Country Planning (Scotland) Act 1972, which provides that a change of use of a building or other land does not involve development for the purposes of the Act if the new use and the former use are both within the same specified class.
