Scottish Statutory Instrument
These Regulations make provision for the payment of fees to a planning authority in respect of local reviews conducted by virtue of section 43A(8)(a) or (b) of the Town and Country Planning (Scotland) Act 1997. The level of fee is to be calculated in accordance with the schedule.

Sections 293B and 293C of the Town and Country Planning Act 1990 (c. 8) (as inserted by section 109 of the Levelling-up and Regeneration Act 2023 (c. 55)) provide a route for applications for planning permission for Crown development in England where the development is considered to be of national importance, and where it is also necessary that the development be carried out as a matter of urgency.

These Regulations, which extend to England only, apply in relation to any person who is after 1st October 2000 appointed to conduct, or is appointed as one of the persons who are to conduct, an examination in public under section 35B(1) of the Town and Country Planning Act 1990 and whose remuneration, and travelling or subsistence allowances (if any), in respect of the appointment are to be paid by the local planning authority.

Northern Ireland Statutory Rule
These Regulations amend the Planning (Fees) Regulations (Northern Ireland) 1995 (“the 1995 Regulations”) which prescribe fees payable to the Department of the Environment in respect of applications made under the Planning (Northern Ireland) Order 1991 –for planning permission for development of land and for approval of matters reserved in an outline planning permission;for consent for the display of advertisements;for listed building consent;for certificates of lawful use or development.

This instrument amends the Town and Country Planning (General Permitted Development) (England) Order 2015 (S.I. 2015/596) (“the GPDO”). The GPDO provides, for the purposes of section 59 of the Town and Country Planning Act 1990 (c. 8), for the granting of permission for certain classes of development without the requirement for a planning application to be made under Part 3 of that Act.

This Order amends the Planning Act 2008 (c. 29) (“the 2008 Act”) to reintroduce onshore wind generating stations into the definition of nationally significant infrastructure projects under the 2008 Act. It also sets the capacity threshold at which onshore wind and solar projects are nationally significant infrastructure projects at more than 100 megawatts.
