These Regulations make provision necessary for the operation in the United Kingdom of Regulation (EU) No 305/2011 of the European Parliament and of the Council laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC (OJ No L 88, 4.4.2011, p.5) (“the 2011 Regulation”). The Regulations revoke the Construction Products Regulations 1991 (S.I. 1991/6120, amended by S.I. 1994/3051) (“the 1991 Regulations”), which implemented Council Directive 89/106/EEC on the approximation of laws, regulations and administrative provisions of the Member States relating to construction products (OJ No L 40, 11.2.1989, p.12) in the United Kingdom.

This instrument is part of a number of Regulations which implement Part 3 of the Building Safety Act 2022. That Act inserts section 91ZA into the Building Act 1984. Section 91ZA, which is to have effect from 1st October 2023, provides for the regulator to be the building control authority in relation to any higher-risk building in England and any proposed higher-risk building. The Act also introduces a new regulatory regime for the building control profession under which approved inspectors will be replaced by registered building control approvers.

Welsh Statutory Instrument
These Regulations make provision for the recovery of charges for and in connection with the performance of the Welsh Ministers’ functions under Part 2A of the Building Act 1984 (“Part 2A”). Part 2A, which is inserted by section 42 of the Building Safety Act 2022, makes provision in relation to the regulation of the building control profession and oversight of those exercising building control functions.

In Great Britain the Construction Plant and Equipment (Harmonisation of Noise Emission Standards) Regulations 1988 as amended by the Construction Plant and Equipment (Harmonisation of Noise Emission Standards) (Amendment) Regulations 1992 (together “the principal Regulations”) implemented Council Directive 84/532/EEC (OJ No. L300, 19.11.84 p.111) and Council Directive 86/662/EEC (OJ No. L384, 31.12.86, p.1) as amended by Commission Directive 89/514/EEC (OJ No. L253, 30.8.89, p.35). The principal Regulations apply to construction plant and equipment consisting of earth-moving machines as defined in the principal Regulations ie hydraulic or rope-operated excavators, dozers, loaders and excavator-loaders designed for use in or about building or civil engineering operations.
