These Regulations amend the Town and Country Planning (Control of Advertisements) Regulations 1989 in consequence of the Town and Country Planning Act 1990. That Act, together with other enactments, consolidates and replaces the Town and Country Planning Act 1971 (c. 78) and certain related legislation, with effect from 24th August 1990.

Scottish Statutory Instrument
These Regulations amend the Town and Country Planning (Development Management Procedure) (Scotland) Regulations 2008. Regulation 2(2) inserts a definition of “historic battlefield”. This relates to the new inventory of historic battlefields compiled and maintained under section 32B of the Ancient Monuments and Archaeological Areas Act 1979. Regulation2(3) introduces a requirement upon the planning authority to consult the Scottish Ministers in certain cases where an application for planning permission is made for development which may affect a historic battlefield. In terms of regulation 1(2) the requirement to consult applies only to applications for planning permission made on or after 1st August 2012.

This Order consolidates with amendments the Town and Country Planning General Development Order 1977 and subsequent amending instruments, except the provisions relating to planning applications which are reproduced in the Town and Country Planning (Applications) Regulations 1988 (S.I. 1988/1812). The consolidation also incorporates the provision previously made by the special development orders listed in Schedule 7.

These Regulations bring into force sections 64, 65, 67, 68 and 145(5) of the Housing and Planning Act 2016 (c.22) on 26th May 2016. Section 64 enables the Secretary of State to make a payment to a private registered provider (as defined in section 68) in respect of the discount awarded to a tenant of that provider when buying their home under the voluntary right to buy. Section 65 allows the Greater London Authority to make equivalent payments in respect of dwellings in Greater London. Section 67 makes consequential amendments and section 68 provides for the interpretation of Part 4, Chapter 1 of the Act in which the substantive provisions to be commenced appear. Section 145(5) inserts a new section 21A of the Planning and Compulsory Purchase Act 2004 (c. 5) to enable the Secretary of State to direct a local planning authority not to take any step in connection with the adoption of a development plan document pending possible use of other intervention powers.
