This Order amends, as regards England only, the Town and Country Planning (General Development Procedure) Order 1995 by omitting sub-paragraph (c) of article 2B(15). That sub-paragraph prohibits the making of a local development order which would grant planning permission for development that is likely to have a significant effect on a European site as defined in regulation 10 of the Conservation (Natural Habitats, &c.) Regulations 1994 (S.I. 1994/2716). The revocation is consequential on regulation 5(36) of the Conservation (Natural Habitats, &c.) (Amendment) Regulations (S.I. 2007/1843), which inserts provision to similar effect as article 2B(15)(c) in regulation 64A of the 1994 Regulations.

These Regulations amend the Local Government, Planning and Land Act 1980 (Competition) (Scotland) Regulations 1995 (“the principal Regulations”) with effect from December 1996 so as to introduce further conditions which authorities must comply with before carrying out certain construction and maintenance work at their own hand.

Section 36 of the Town and Country Planning Act 1971 confers a right of appeal against certain planning decisions of local planning authorities. Its provisions are extended, by section 37 of the Act, to cases where a local planning authority fails to notify a planning decision within prescribed periods and, by section 53 of the Act, to determinations by local planning authorities of whether planning permission is required.

These Regulations bring into force sections 64, 65, 67, 68 and 145(5) of the Housing and Planning Act 2016 (c.22) on 26th May 2016. Section 64 enables the Secretary of State to make a payment to a private registered provider (as defined in section 68) in respect of the discount awarded to a tenant of that provider when buying their home under the voluntary right to buy. Section 65 allows the Greater London Authority to make equivalent payments in respect of dwellings in Greater London. Section 67 makes consequential amendments and section 68 provides for the interpretation of Part 4, Chapter 1 of the Act in which the substantive provisions to be commenced appear. Section 145(5) inserts a new section 21A of the Planning and Compulsory Purchase Act 2004 (c. 5) to enable the Secretary of State to direct a local planning authority not to take any step in connection with the adoption of a development plan document pending possible use of other intervention powers.

These Regulations further amend the Building Regulations 1991 (S.I. 1991/2768). The amendments—insert a new regulation 13A providing for regularisation certificates in relation to unauthorised work (Regulation 2(3));insert a new regulation 14A providing for energy rating of new dwellings (regulation 2(4));revoke Requirement A4 relating to disproportionate collapse (regulation 2(5)(a)) and make a consequential amendment (regulation 2(2)(b));substitute the limits on application of Requirement F1 relating to means of ventilation (regulation 2(5)(b)); andsubstitute Requirement L1 relating to conservation of fuel and power (regulation 2(5)(c)) and apply that Requirement in certain cases of material change of use (regulation 2(2)(a)).
