The Black Country Development Corporation was established by the Black Country Development Corporation (Area and Constitution) Order 1987 for the purpose of regenerating the Black Country urban development area. This Order makes the corporation the local planning authority for that area for all the purposes of Part III (general planning control) of the Town and Country Planning Act 1971 (article 3(a)), and for those purposes which are specified in Part I of Schedule 29 to the Local Government, Planning and Land Act 1980 which deal with additional control in special cases, enforcement of control, listed buildings and conservation areas (article 3(b)).

These Regulations, which apply to England and Wales, apply where the Secretary of State is authorised to recover costs borne by him in connection with unitary development plan, local plan or simplified planning zone inquiries or other hearings or examinations in public in respect of structure plans (“qualifying inquiries”). They do not apply in relation to a person who is appointed to conduct an examination in public, under section 35B(1) of the Town and Country Planning Act 1990, where that person’s remuneration and travelling or subsistence allowances (if any) are to be paid by the local planning authority.

These Rules regulate the procedure to be followed in connection with local inquiries in England or Wales caused by the Secretary of State to be held by inspectors before he determines applications referred to him, or appeals made to him, in relation to planning permission, consent under tree preservation orders, listed building consent and consent for the demolition of unlisted buildings in conservation areas (known as “conservation area consent”).
