These Regulations amend the Neighbourhood Planning (Referendums) Regulations 2012 (S.I. 2012/2031) (the “2012 Regulations”). Their main purpose is to apply, for the purposes of neighbourhood planning referendums, changes that have been or are to be made to the legislation relating to the administration of parliamentary and local government elections.

These Rules regulate the procedure to be followed in connection with local inquiries in Wales held by the National Assembly for Wales (“the National Assembly”) before it determines applications referred to it, or appeals made to it, on or after 1st June 2003 in relation to planning permission, listed building consent, consent for the demolition of unlisted buildings in conservation areas (“conservation area consent”), tree preservation order consents or tree preservation enforcement notices.

This Order, which applies in England only, amends the Town and Country Planning (General Development Procedure) Order 1995 (“the 1995 Order”). The main changes are—The introduction of a requirement to consult, in England, the Regional Development Agency before the grant of planning permission for certain categories of development (article 3).The introduction of an additional exception to the requirement to consult before the grant of planning permission, for development which is not EIA development where a local planning authority considers that the development proposed is subject to any up to date standing advice issued by the relevant consultee in respect of a category of development. (article 4).The introduction of a requirement for the local planning authority to provide a summary of the reasons for a grant of planning permission and a summary of the policies and proposals in the development plan which are relevant to the decision. (article 5).An amendment altering the time limit for appeals from six to three months. (article 6).There are other minor changes and transitional provisions.

Section 174 of the Town and Country Planning Act 1990 and section 39 of the Listed Buildings Act 1990 confers a right of appeal against an enforcement notice and a listed building enforcement notice on a person having an interest in the land to which the enforcement notice relates or is a relevant occupier.
