These Regulations revoke, in relation to England, the Building (Approved Inspectors etc.) Regulations 2010 (S.I. 2010/2215) (“the AI Regulations”) with the amendments to those Regulations made by S.I. 2015/767, 2016/285, 2021/1391, 2021/1392, 2022/718 and 2023/906. They also revoke and include in this instrument provisions relating to the registration and review in regulations 3 to 5 of the Building (Approved Inspectors, Review of Decisions) (England) Regulations 2023 (S.I. 2023/906).

This instrument is part of a set of Regulations which implement Part 4 of the Building Safety Act 2022 (“the 2022 Act”). These Regulations make provision about what information and documents the principal accountable person (“PAP”) and any other accountable person (“AP”) for a higher-risk building must keep in relation to that higher-risk building. The term “higher-risk building” is defined in section 65(1) of the 2022 Act as a building in England that is at least 18 metres in height, or has at least 7 storeys, and contains at least 2 residential units. The definition is supplemented by the Higher-Risk Buildings (Descriptions and Supplementary Provisions) Regulations 2023 (S.I. 2023/275).

Welsh Statutory Instrument
These Regulations prescribe periods for registration of a registered building inspector and registered building control approver, set out the sanctions for registered building control approvers and deal with appeals of a decision made by the Welsh Ministers, who are the regulatory authority in relation to Wales, under Part 2A of the Building Act 1984 (“the Act”).

Welsh Statutory Instrument
These Regulations make provision for the recovery of charges for and in connection with the performance of the Welsh Ministers’ functions under Part 2A of the Building Act 1984 (“Part 2A”). Part 2A, which is inserted by section 42 of the Building Safety Act 2022, makes provision in relation to the regulation of the building control profession and oversight of those exercising building control functions.

This instrument is part of a number of Regulations which implement Part 3 of the Building Safety Act 2022. That Act inserts section 91ZA into the Building Act 1984. Section 91ZA, which is to have effect from 1st October 2023, provides for the regulator to be the building control authority in relation to any higher-risk building in England and any proposed higher-risk building. The Act also introduces a new regulatory regime for the building control profession under which approved inspectors will be replaced by registered building control approvers.

These Regulations provide a list of the activities and functions of local authorities, the building safety regulator (the Health and Safety Executive) and registered building control approvers which are restricted under sections 46A and 54B of the Building Act 1984 (c. 55). Those sections were inserted into that Act by section 44 of the Building Safety Act 2022 (c. 30).
