Northern Ireland Statutory Rule
The Health and Safety at Work Order (Application to Environmentally Hazardous Substances) Regulations (Northern Ireland) 2003 (“the 2003 Regulations”) extend the reference to dangerous substances in Article 3(1)(c) of the Health and Safety at Work (Northern Ireland) Order 1978 (“the 1978 Order”) to include environmentally hazardous substances. The purpose of the 2003 Regulations is to enable regulations to be made under Article 17 of the 1978 Order to implement any obligation imposed by the Directives referred to in regulation 2(1) of the 2003 Regulations.

The Energy Performance of Buildings (Scotland) Amendment (No.2) Regulations 2012 amend the Energy Performance of Buildings (Scotland) Regulations 2008 (“the 2008 Regulations”). The 2008 Regulations transposed the provisions of Directive 2002/91/EC of the European Parliament and of the Council on the energy performance of buildings (OJ L 1, 04.01.2003, p.65) (“the 2002 Directive”).

Northern Ireland Statutory Rule
These Regulations amend the Health and Safety Information for Employees Regulations (Northern Ireland) 1991 (S.R. 1991 No. 105), which require information relating to health, safety and welfare to be furnished to employees by means of posters or leaflets in the form approved and published for the purposes of the Regulations by the Health and Safety Executive for Northern Ireland.

These Regulations revoke and replace the Health and Safety (Enforcing Authority) Regulations (Northern Ireland) 1993 (“the 1993 Regulations”) with amendments. The 1993 Regulations, which applied only to non-domestic premises, made provision with respect to enforcement by district councils of the Health and Safety at Work (Northern Ireland) Order 1978 (“the 1978 Order”) and the other relevant statutory provisions within the meaning of the 1978 Order (“the relevant statutory provisions”) and also specified the premises in respect of which the Department of Agriculture and the Department of Economic Development would be the enforcing authorities under the afore-mentioned legislation.

Section 3(2) of the Health and Safety at Work etc. Act 1974 (“the 1974 Act”) was amended by the Deregulation Act 2015 (c. 20) to limit the scope of the general duty under that section. Only those self-employed persons who conduct undertakings of a prescribed description will have an obligation to conduct their undertaking in such a way as to ensure that, so far as is reasonably practicable, they themselves and other persons who may be affected thereby are not exposed to risks to their health and safety.

These Regulations specify the circumstances in which self-employed persons will be required to comply with their duty under section 3(2) of the Health and Safety at Work etc. Act 1974 (“the 1974 Act”) to conduct their undertakings in such a way as to ensure, so far as reasonably practicable, that they themselves and other persons (not being their employees) who may be affected by their work activities are not exposed to risks to their health and safety. Every self-employed person continues to hold a duty in respect of their employees under section 2 of the 1974 Act.

The Control of Major Accident Hazards Regulations 2015 (S.I. 2015/483) (“the 2015 Regulations”) implemented Directive 2012/18/EU of the European Parliament and of the Council on the control of major accident hazards involving dangerous substances, amending and subsequently repealing Council Directive 96/98/EC (O.J. No. L 197, 24.7.2012, p.1) (“the Seveso III Directive”).
