Welsh Statutory Instrument
Section 54 of the Social Services and Well-being (Wales) Act 2014 imposes a duty on a local authority to prepare and maintain a care and support plan for an adult or child to whom it owes a duty to meet needs under section 35 or 37 of the Act and to prepare a support plan for a carer to whom it owes a duty to meet needs under section 40 or 42 of the Act. These Regulations make further provision about such plans.

Article 2 of this Order brings into force on 9th November 1992 the following provisions of the Planning and Compensation Act 1991—section 12(1) (planning obligations), so far as it is not yet in force;section 32 (planning: minor and consequential amendments), in so far as it relates to paragraphs 9(2)(d) (so far as that paragraph is not yet in force), 53(5) (local planning authorities: distribution of functions) (so far as that paragraph is not yet in force), 54(2), (3)(b) and (f) and 57(2)(f) (planning obligations); andsection 84(6) (repeals) and Schedule 19 in so far as they relate to repeals in Part I of Schedule 19 specified in the Schedule to this Order.

This Order amends Parts 1, 24 and 25 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (“the 1995 Order”). Those Parts confer permitted development rights in respect of certain telecommunications development, including the erection of satellite antennas. Where such rights apply, no specific application for planning permission is needed.

The Local Government, Planning and Land Act 1980 makes provision as to compulsory competition tendering (“CCT”) in respect of certain construction and maintenance work undertaken by local authorities and development bodies. The Local Government, Planning and Land Act 1980 (Competition) (Scotland) Regulations 1995 (“the 1995 Regulations”) have, since 31st March 1995, applied 1980 Act CCT in Scotland only to jobs over £500,000 in value. The 1995 Regulations would, in terms of the Local Government, Planning and Land Act 1980 (Competition) (Scotland) Regulations 1996 (“the 1996 Regulations”), have been repealed and replaced as at 1st July 1997. These Regulations revoke the 1996 Regulations before they come into force and make consequential amendments to the 1995 Regulations so as to make them of continuing application.
