These Regulations replace on 1st July 1997 the Local Government, Planning and Land Act 1980 (Competition) (Scotland) Regulations 1995, as amended, by changing the levels above which certain services provided by local authorities require to be exposed to competitive tender. The 1995 Regulations, which required less work to be exposed to competitive tender than had previously been the case, were enacted in recognition of the additional administrative work which local government reorganisation placed upon local authorities.

These Regulations replace on 1st April 1994 the Local Government (Direct Labour Organisations) (Competition) Regulations 1989 so far as they apply to local authorities in Wales. This is in recognition of the additional administrative work which local government reorganisation in Wales will place upon Welsh local authorities.

Section 108 of the Town and Country Planning Act 1990 provides for the payment of compensation in certain cases where planning permission for development granted by a development order or a local development order is withdrawn and where on an application for planning permission for that development, the application is refused.

These Regulations amend the Town and Country Planning (Control of Advertisements) Regulations 1989 in consequence of the Town and Country Planning Act 1990. That Act, together with other enactments, consolidates and replaces the Town and Country Planning Act 1971 (c. 78) and certain related legislation, with effect from 24th August 1990.

Section 299 of the Town and Country Planning Act 1990 enables the appropriate authority (for example a Government Department or the Crown Estates Commissioners) or a person authorised by that authority to apply for planning permission or for a certificate of lawfulness of proposed use or development in respect of Crown land. This enables a permission or certificate to be obtained in anticipation of the disposal of such land.

These Regulations prescribe modifications to the Town and Country Planning Act 1990 and to the Town and Country Planning (General Development Procedure) Order 1995, in their application to Crown land. The modifications relate to applications in respect of Crown land for planning permission and for lawful development certificates. The Regulations supersede the Town and Country Planning (Crown Land Applications) Regulations 1992 which are revoked.

This Order consolidates with amendments the procedural provisions of the Town and Country Planning General Development Order 1988 and subsequent amending instruments. A separate Order, the Town and Country Planning (General Permitted Development) Order 1995 (S.I. 1995/418), consolidates with amendments the remaining provisions which deal with permitted development.
