Article 2 of this Order brings into force, on 1st October 2009, paragraphs 24 to 27 of Schedule 1 to the Planning Act 2008. The effect of this, together with section 240(6) of the Planning Act 2008, is that those paragraphs, which make amendments to various enactments so as to insert references to the Infrastructure Planning Commission, will be in force for the United Kingdom.

These Rules regulate the procedure to be followed for hearings in England caused by the Secretary of State to be held before he or an inspector determine appeals made to him against enforcement notices, listed building and conservation area consent enforcement notices and non-determination of applications for a certificate of lawful use development on or after 23rd December 2002. The Rules come into force on 23rd December 2002.

These Rules regulate the procedure to be followed for hearings in Wales caused by the National Assembly for Wales (“the National Assembly”) to be held before it, or an inspector, determines appeals made to it against enforcement notices, listed building and conservation area consent enforcement notices and non-determination of applications for a certificate of lawful use development on or after 1st June 2003. The Rules come into force on 1st June 2003.

These Rules regulate the procedure to be followed for hearings in England caused by the Secretary of State to be held before he or an inspector determines appeals made to him in relation to planning permission, listed building consent and consent for the demolition of unlisted buildings in conservation areas (“conservation area consent”) on or after 1st August 2000. The Rules come into force on 1st August 2000.

These Rules regulate the procedure to be followed in Wales for hearings caused by the National Assembly for Wales (“the National Assembly”) to be held by a person appointed by it (an “inspector”), before it, or the inspector, determines an application made on or after 1st June 2003 in relation to an application for planning permission or listed buildings consent which has been referred to the National Assembly or an appeal brought on or after that date in relation to planning permission, listed building consent, consent for the demolition of unlisted buildings in conservation areas (“conservation area consent”), tree preservation enforcement notices or tree preservation order consents.

Schedule 2 to the Planning and Compulsory Purchase Act 2004 requires the Secretary of State to make timetables for the purposes of decisions to which that Schedule applies, and enables him by order to specify decisions or descriptions of decision to which a timetable is not to apply. This Order specifies those descriptions of decision.

Northern Ireland Statutory Rule
This Order amends the Planning (2011 Act) (Commencement No.3) and (Transitional Provisions) Order (Northern Ireland) 2015 in relation to the transitional arrangements for revocation or discontinuance orders issued by the Department prior to the transfer of responsibility for the majority of planning decisions to councils.
