Article 2 of this Order brings into force, on 1st March 2010, section 36 of and Schedule 2 to the Planning Act 2008 (“the Act”) in relation to the United Kingdom (amendments consequential on the development consent regime).

Northern Ireland Statutory Rule
These Regulations impose health and safety requirements with respect to the provision for, and use by, persons at work of personal protective equipment. Personal protective equipment is defined in regulation 2 and certain types of such equipment are excluded from the application of regulations 4 to 12 by regulation 3(2).

The Planning Act 2008 (“the Act”) provides for the granting of an order for development consent for development which is or forms part of a nationally significant infrastructure project. Development consent is required for certain types of energy, water, waste water, transport and waste projects. The Act also establishes the Infrastructure Planning Commission (“the Commission”) which is responsible for examining, and in most cases, determining applications for development consent. Section 4 of the Act enables the Secretary of State to make regulations for the charging of fees by the Commission in relation to the performance of any of its functions.

United Kingdom Statutory Instrument
These Regulations make provision for the conduct of referendums held under paragraph 16 of Schedule 4B to the Town and Country Planning Act 1990 (“the 1990 Act”). These Regulations only apply in relation to England. The referendums will relate to the question of whether a neighbourhood plan, neighbourhood development order or a community right to build order is approved.

Northern Ireland Statutory Rule
These Regulations revoke and re-enact the Control of Lead at Work Regulations (Northern Ireland) 1986 (“the 1986 Regulations”) with modifications. The 1986 Regulations imposed requirements for the protection of employees who might be exposed to lead at work and of others who might be affected by such work.

Northern Ireland Statutory Rule
These Regulations amend various statutory provisions to take account of the amendments to the Health and Safety at Work (Northern Ireland) Order 1978, S.I. 1978/1039 (N.I. 9) (“the 1978 Order”) made by the Health and Safety at Work (Amendment) (Northern Ireland) Order 1998, S.I. 1998/2795 (N.I. 18). The latter Order renames the Health and Safety Agency for Northern Ireland as the Health and Safety Executive for Northern Ireland and provides for the Executive to enforce the provisions of the 1978 Order and to provide the employment medical advisory service.

The Planning Act 2008 (“the Act”) establishes the Infrastructure Planning Commission and provides for the granting of development consent for certain types of nationally significant infrastructure projects. Part 6 of the Act sets out the procedure for examining applications for development consent. Part 7 contains provisions in respect of what can be included in an order granting development consent. Among other things, an order granting development consent can authorise the compulsory acquisition of land.

These Regulations make provision under section 2(1) of the Trade Act 2021 to implement provisions relating to co-operation in the regulation of chemicals contained in the EEA EFTA Agreement. The Regulations also make amendments to retained EU legislation in exercise of powers conferred by sections 8(1) and 8C(1) of the European Union (Withdrawal) Act 2018 and by paragraph 7 of Schedule 4 to that Act.

This Order, made on the application of the Agency, makes provision to meet a deficiency in the level of water in the Black Moss Reservoir, which arises from an exceptional shortage of rain and poses a serious threat to the flora and fauna which are dependent on those waters, including flora and fauna in Black Moss Water, a river into which these reservoirs flow. In accordance with section 74(3) of the Water Resources Act 1991 (c. 57), this Order will cease to have effect on 17th April 2023 (within six months of the day on which the Order comes into force).
