Part 2 of the Regulations amends the Building Regulations 2010 (“the 2010 Regulations”) to insert provisions relating to target fabric energy efficiency (“TFEE”) rates and new dwellings. Regulation 4 amends regulation 25 of the 2010 Regulations requiring the Secretary of State to approve TFEE rates; regulation 5 inserts regulation 26A requiring that new dwellings must not exceed the TFEE rate; regulation 6 inserts regulation 27A setting out the procedure to be followed by the person carrying out the work to submit evidence regarding the TFEE rates to the local authority; regulation 8 inserts a definition of fabric energy efficiency into regulation 35 of the 2010 Regulations and regulation 9 sets out the transitional provisions for the amendments to the 2010 Regulations

This Order provides for circumstances in which a relevant authority in England or a police authority in Wales may provide an indemnity to any of their members or officers. The Local Authorities (Elected Mayors) (England) Regulations 2004 (S.I. 2004/1815) provide that the term “member” shall, in this context, include any elected mayor. These powers are in addition to any existing powers that such authorities may have (such as powers under section 111 of the Local Government Act 1972). The relevant authorities in England are—county councils;district councils;London borough councils;parish councils;the Greater London Authority;the Metropolitan Police Authority;the London Fire and Emergency Planning Authority;the Common Council of the City of London (in its capacity as a local or police authority);the Council of the Isles of Scilly;a fire authority constituted by a combination scheme under the Fire Services Act 1947;a police authority;a joint authority established by Part IV of the Local Government Act 1985;the Broads Authority;a National Park Authority established under section 63 of the Environment Act 1995.

These Regulations, which apply in England only, apply in relation to any person who is after 23rd May 2003 appointed to conduct, or is appointed as one of the persons who are to conduct, an examination in public under section 35B(1) of the Town and Country Planning Act 1990 and whose remuneration, and travelling or subsistence allowances (if any), in respect of the appointment are to be paid by the local planning authority.

These Regulations apply to work done by the appointed person in connection with his appointment in relation to any day which falls on or after the date on which the Regulations come into force.

The Energy Performance of Buildings (Scotland) Amendment (No.3) Regulations 2012 amend the Energy Performance of Buildings (Scotland) Regulations 2008 (“the 2008 Regulations”). The 2008 Regulations transposed the provisions of Directive 2002/91/EC of the European Parliament and of the Council on the energy performance of buildings (recast) (OJ L 1, 4.1.2003, p.65) (“the 2002 Directive”).
