Schedule 2 to the Planning and Compulsory Purchase Act 2004 requires the Secretary of State to make timetables for the purposes of decisions to which that Schedule applies, and enables him by order to specify decisions or descriptions of decision to which a timetable is not to apply. This Order specifies those descriptions of decision.

These Rules regulate the procedure to be followed in Wales for hearings caused by the National Assembly for Wales (“the National Assembly”) to be held by a person appointed by it (an “inspector”), before it, or the inspector, determines an application made on or after 1st June 2003 in relation to an application for planning permission or listed buildings consent which has been referred to the National Assembly or an appeal brought on or after that date in relation to planning permission, listed building consent, consent for the demolition of unlisted buildings in conservation areas (“conservation area consent”), tree preservation enforcement notices or tree preservation order consents.

These Rules regulate the procedure to be followed for hearings in England caused by the Secretary of State to be held before he or an inspector determines appeals made to him in relation to planning permission, listed building consent and consent for the demolition of unlisted buildings in conservation areas (“conservation area consent”) on or after 1st August 2000. The Rules come into force on 1st August 2000.

These Regulations alter in advance the amendment to the Town and Country Planning (Use Classes) Order 1987 (S.I. 1987/764) effected by the Town and Country Planning (Use Classes) (Amendment) (England) Regulations 2020 (S.I. 2020/757) with respect to references to use classes contained in charging schedules which are published before 1st September 2020 by charging authorities under regulation 25 of the Community Infrastructure Levy Regulations 2010 (S.I. 2010/948).

Scottish Statutory Instrument
These Regulations amend the Town and Country Planning (Emergency Period and Extended Period) (Coronavirus) (Scotland) Regulations 2021 to correct references in regulations 4(2)(b) and 5(1) of those Regulations. Amendments made to regulation 5 of those Regulations ensure that the saving provisions extend to listed building consents and conservation area consents granted before 30 September 2021. Definitions of “planning permission” and “planning permission in principle” are included in regulation 4 and definitions of “listed building consent” and “conservation area consent” are included in regulation 5.
