These regulations impose requirements with respect to the control of major accident hazards involving dangerous substances. (The expressions “major accident” and “dangerous substances” are defined in regulation 2(1)). The Regulations implement Council Directive 96/82/EC on the control of major accident hazards involving dangerous substances, except Article 12 (which relates to land use planning).

Scottish Statutory Instrument
This Order prescribes £24,725 as the limit of annual value for the purposes of section 100(3)(a) of the Town and Country Planning (Scotland) Act 1997 (which relates to the circumstances in which authorities may be obliged to purchase interests of owner-occupiers affected by planning proposals) and replaces the limit of £21,500 prescribed by the Town and Country Planning (Limit of Annual Value) (Scotland) Order 1995 (which is itself revoked).

These Regulations amend the Town and Country Planning (Compensation for Restrictions on Mineral Working) Regulations 1985. The amendments are—amendments to regulations 3 and 4 (modifications to sections 164 and 170 of the Town and Country Planning Act 1971) to ensure that claimants are not able to include expenditure incurred by voluntary agreement in more than one compensation claim (regulations 3 and 4);the substitution in consequence of the revised valuation date for rateable values of 0.0094518 for 0.0428339 as the multiplier to be used in the calculation of the annual value of the right to win and work minerals (regulations 8(e));a revision of the figures of £2,500, £5,000 and £100,000 in regulations 5, 6 and 7 of the 1985 Regulations to £3,200, £6,400 and £128,000 respectively (regulations 5, 6 and 7);the replacement of references in Schedules 1 and 2 to the 1985 regulations to factors connected with the rating system under the General Rate Act 1967 (c. 9) by reference to corresponding factors connected with the new rating system under the Local Government Finance Act 1988 and some consequential redrafting (regulations 8 and 9).

Schedule 22 to the Greater London Authority Act 1999 amends Part X of the Town and Country Planning Act 1990 so as to enable orders authorising the stopping up of highways or extinguishing rights to use vehicles on highways to be made by London borough councils and the Common Council of the City of London. Regulation 3 of these Regulations enables councils to impose charges in connection with applications for the making of such orders. Regulation 4 provides for the charges to be payable by the person making the application and regulation 5 makes provision as to the amount of the charges.

Section 20A of the Land Compensation Act 1973, inserted by paragraph 5(1) of Schedule 15 to the Planning and Compensation Act 1991, enables Regulations to be made providing for payments to persons living in caravans and other structures which are not buildings which are, or are likely to be, affected by noise caused by the construction or use of public works. Such dwellings do not qualify for noise insulation or grant under the Noise Insulation Regulations 1975 (S.I. 1975/1763 amended by S.I. 1988/2000), but these Regulations empower a noise payment to be made where qualifying conditions are met, to the occupier of a caravan or movable home by the appropriate highway authority, of £1,650 specified in the Regulations. This Order prescribes £21,500 as the limit of annual value for the purposes of section 181 of the Town and Country Planning (Scotland) Act 1972 (which relates to the circumstances in which authorities may be obliged to purchase interests of owner-occupiers affected by planning proposals) and replaces the limit of £12,000 prescribed by the Town and Country Planning (Limit of Annual Value) (Scotland) Order 1985.

United Kingdom Statutory Instrument
Section 69 of the Enterprise and Regulatory Reform Act 2013 (c.24) made amendments to section 47 of the Health and Safety at Work etc. Act 1974. As a consequence some references to section 47 in other legislation are redundant and this Order deletes them. No impact assessment has been prepared for this Order as its sole purpose is to remove references to legislation which are no longer required.
