Northern Ireland Statutory Rule
These Regulations give the protection for and duties of employees under the Health and Safety at Work (Northern Ireland) Order 1978 (“the 1978 Order”) and the other relevant statutory provisions to those who are provided with “relevant training” as defined in regulation 2. “Relevant statutory provisions” is defined in Article 2(2) of the 1978 Order.

These Regulations amend the Town and Country Planning (Fees for Applications and Deemed Applications) (Scotland) Regulations 1990 “the principal Regulations”, which make provision for the payment of fees to planning authorities in respect of—applications made under Part III of the Town and Country Planning (Scotland) Act 1972 for planning permission for development or for approval of matters reserved by an outline planning permission and in respect of applications for consent for the display of advertisements;applications for planning permission which are deemed to have been made, by virtue of the provisions of section 85(7) of the 1972 Act, in connection with an appeal against an enforcement notice; andapplications for certificates of lawful use or development made under sections 90 and 90A of the 1972 Act.

This Order amends the Town and Country Planning General Development Order 1988. The main changes are—an amendment to article 12 of the 1988 Order in connection with notices of applications for planning permission given by applicants prior to the applications being made, and (in article 12A of the 1988 Order) certification in the appropriate form that the requirements have been satisfied (article 3);the insertion of article 12B of the 1988 Order, providing for publicity for applications for planning permission to be given by a local planning authority (article 4);the insertion of article 22A of the 1988 Order, providing for representations to be taken into account by a local planning authority (article 6);the amendment of article 23 of the 1988 Order to prescribe periods within which a local planning authority shall not determine an application for planning permission (article 7);the amendment of Parts 6 and 7 of Schedule 2 to the 1988 Order (agricultural and forestry buildings and operations) to require notices to be displayed where the local planning authority determines that prior approval is required for siting, design etc. (articles 8 and 9).

This Order amends the Town and Country Planning General Development Order 1988. The conditions as to siting, design and external appearance attached to permitted development rights relating to agricultural and forestry buildings and operations contained in Parts 6 and 7 of Schedule 2 to the 1988 Order are amended as follows—the Order introduces a requirement for the developer to apply for a determination as to whether the prior approval of the local planning authority is required to the siting, design and external appearance of a building and the siting and means of construction of a private way before development commences;this requirement applies in the case of the erection or significant extension or alteration of a building, and the formation or alteration of a private way;the conditions are no longer limited to article 1(6) land (National Parks, adjoining land and the Broads).

This Order amends the Medicines (Control of Substances for Manufacture) Orders 1971 and 1985, limiting the application of those Orders to substances for veterinary use. Those Orders extend the application of specified provisions of the Medicines Act 1968 to certain substances which are not themselves medicinal products but which are used as ingredients in the manufacture of medicinal products.

These Regulations give further effect, in England and Wales, to Council Directive 94/33/EC on the protection of young people at work (O.J. L216 of 20th August 1994, page 12). Regulation 2(1) amends section 18 of the Children and Young Persons Act 1933, raising to thirteen the minimum age at which children may be authorised by local authority byelaws to be employed in light agricultural or horticultural work. Regulation 2(2) amends section 20 of the Act so that local authority byelaws authorising children to take part in street trading must contain provisions determining the days and hours during which, and the places at which, they may do so. Regulation 2(3) amends section 23 of the Act so that only persons aged at least sixteen and who are also over compulsory school age may take part in performances of a dangerous nature.

These Regulations give further effect, in England and Wales, to Council Directive 94/33/EC on the protection of young people at work (O.J. L216 of 20.8.94, page 12). Article 17(1)(b) provided a derogation to Article 8(1)(b), (maximum number of hours which may be worked by children in term time). This derogation has come to an end and these Regulations give full effect to this Article. Regulation 2 amends section 18 of the Children and Young Persons Act 1933, to place a limit on the number of hours that a child may be employed in any week in which they are required to attend shcool.
