Scottish Statutory Instrument
This Order corrects errors in the schedule to the Town and Country Planning (General Permitted Development) (Scotland) Amendment Order 2014 (“the 2014 Order”). The 2014 Order amends the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 to include new classes of permitted development. Article 2 corrects errors in the 2014 Order by inserting definitions of “enclosed shopping centre” and “retail park” into new class 9A and omits these definitions from new class 9B. It also inserts a definition of “raised platform” in new classes 9C and 9D.

These Regulations amend the Town and Country Planning (Fees for Applications and Deemed Applications) (Scotland) Regulations 1990 (“the principal Regulations”), which make provision for the payment of fees to planning authorities in respect of—applications made under Part III of the Town and Country Planning (Scotland) Act 1972 for planning permission for development or for approval of matters reserved by an outline planning permission and in respect of applications for consent for the display of advertisements;applications for planning permission which are deemed to have been made, by virtue of the provisions of section 85(7) of the 1972 Act, in connection with an appeal against an enforcement notice; andapplications for certificates of lawful use or development made under sections 90 and 90A of the 1972 Act.

Scottish Statutory Instrument
This Order brings all the provisions of the Flood Risk Management (Scotland) Act 2009 into force on 26th November 2009, except section42 (amendment to planning regulations) and Parts 4 (local authority powers to manage flood risk), 6 (powers of entry and compensation) insofar as it relates to Part 4, and 7 (reservoirs). The Act received Royal Assent on 16th June 2009 and Part 2 (sections 3 to 6) and sections 55, 71, 94, 95 and 97 came into force on that day.

These Regulations implement, as respects Great Britain, Council Directive No. 85/610/EEC (OJ No. L375, 31.12.85, p.1) which amends Council Directive No. 76/769/EEC (OJ No. L262, 27.9.76, p.201) on the marketing and use of asbestos. They do so by amending the Asbestos (Prohibitions) Regulations 1985 (S.I. 1985/910).

These Regulations make changes in consent procedures for the display of local authority advertisements requiring express consent. Such procedures are set out in the Town and Country Planning (Control of Advertisement) Regulations 1992. Regulation 6 of, and Schedule 3 to the 1992 Regulations give deemed consent for extensive classes of local authority advertisements, and these Regulations apply only where those provisions do not cover the particular advertisement proposal.

These Regulations amend the Health and Safety (Training for Employment) Regulations 1988 which give to certain trainees who are not employees the protection for and duties of employees under the relevant statutory provisions as defined in the Health and Safety at Work etc. Act 1974. The 1988 Regulations apply to training provided pursuant to arrangements made under section 2 of the Employment and Training Act 1973 (c. 50) and known by any of the names specified in the Schedule to those Regulations.

The Town and Country Planning (Compensation for Restrictions on Mineral Working) Regulations 1985 specify methods of calculating the annual value of the right to win and work minerals for the purpose of assessing compensation in certain situations where restrictions on permission for mining are imposed. The calculation includes a factor relating to the base of the Retail Price Index. The Index was rebased on 1st January 1987. These Regulations amend the factor to take account mathematically of the rebasing.
