This Order amends the Town and Country Planning (General Permitted Development) (Scotland) Order 1992 as follows:—it inserts a definition of “licensed premises” which was omitted in error from the Order;it substitutes a new provision in place of article 8(2)(b) which has the effect of correcting the erroneous reference in that provision to the saving of various specified directions as if they had been given “under this article”;it deletes from the definition of “terrace house” at sub-paragraph (3)(c)(ii) of Class 1 of Schedule 1 the words “at the end of a row” which were included in error;it makes a minor amendment for the purpose of clarifying sub-paragraph (2)(c) of Class 3 of Schedule 1;in relation to agricultural and forestry development consisting of the formation or alteration of a private way it removes the requirement to apply to the planning authority for a determination as to whether prior approval as to siting and means of construction is required. This requirement was included in error; andit amends sub-paragraph (2)(f) of Class 68 of Schedule 1 so that the development permitted by way of Class 68 does not apply within a national scenic area. This was the position immediately before the Order came into force.

These Regulations are made under the Town and Country Planning Act 1990 (c. 8) and the Levelling-up and Regeneration Act 2023 (c. 55) (“the 2023 Act”). They set out the process to be followed when a local authority exercises the powers given to it in Part 10 of the 2023 Act to arrange for a rental auction to be carried out in respect of qualifying high-street premises. They also amend the Town and Country Planning (General Permitted Development) (England) Order 2015 (S.I. 2015/596) (“the General Permitted Development Order”) to provide for temporary planning permission for a change of use of such premises to a suitable high-street use for the duration of a tenancy granted following a rental auction held under Part 10 of the 2023 Act.

In response to the coronavirus pandemic, sections 1-10 of the Business and Planning Act 2020 (“the 2020 Act”) made temporary provision for a fast-track process to allow businesses selling food or drink to obtain authorisation from the local authority for the placement of furniture such as tables and chairs on highway adjacent to their premises (a “pavement licence”).

Northern Ireland Statutory Rule
These Regulations amend the Planning (Fees) Regulations (Northern Ireland) 2015 which prescribe the fee payable in respect of applications made under the Planning Act (Northern Ireland) 2011. The Regulations increase planning fees by approximately 2.1% overall. Regulation 3 revokes the Planning (Fees) (Amendment) Regulations (Northern Ireland) 2024.
