Scottish Statutory Instrument
These Regulations make provision regarding the making of tree preservation orders under section 160 of the Town and Country Planning (Scotland) Act 1997 (“the Act”). They replace and revoke the Town and Country Planning (Tree Preservation Order and Trees in Conservation Areas) (Scotland) Regulations 1975.

These Regulations implement, in relation to town and country planning in Scotland, Article12 of Council Directive96/82/EC on the control of major accident hazards involving dangerous substances (O.J.No.L10, 14.1.1997, p.13) (the Seveso II Directive), as amended by Council Directive2003/105/EC (O.J.No.L345, 31.12.2003, p.97) (the 2003 Directive).

This Order preserves Part 2 of the Town and Country Planning (Scotland) Act 1997 (“the 1997 Act”) in full force and effect notwithstanding the commencement for certain purposes of section 2 of the Planning etc. (Scotland) Act 2006 (“the 2006 Act”). Section 2 of the 2006 Act substitutes a new Part 2 for Part 2 of the 1997 Act.

This Order amends the Planning etc. (Scotland) Act 2006 (Development Planning) (Saving, Transitional and Consequential Provisions) Order 2008 (“the 2008 Order”). Article2 changes the modifications applied by article5 of the 2008 Order to alter the circumstances in which the new section19 of the Town and Country Planning (Scotland) Act 1997 introduced by section2 of the Planning etc. (Scotland) Act 2006 require an examination to be held in respect of a local plan.

Scottish Statutory Instrument
These Regulations make provision for the manner in which applications for planning permission, for approvals required by a condition imposed on a grant of planning permission in principle and for certificates of lawful use and development under the Town and Country Planning (Scotland) Act 1997 (“the Act”) are to be made. These Regulations apply to all applications made on or after 3rd August 2009. They also apply to the limited extent provided for in Part 11 in respect of applications made before that date but not yet determined by that date.
