Under the Housing Act 1980 liability to repay discount following the exercise of the right to buy is secured by a charge on the dwelling. The charge has priority in the circumstances set out in section 8(4)(b) and (4A) (substituted by section 5(4) of the Housing and Building Control Act 1984) of the 1980 Act after certain legal charges, including charges securing amounts advanced by a body falling within section 8(5) of the 1980 Act. Certain bodies are listed in section 8(5).

This Order consolidates with amendments the provisions of the Town and Country Planning (General Development Procedure) Order 1995 (“the 1995 Order”) and subsequent amending instruments, in so far as they apply to England. It also includes provisions regarding the application of this Order to the Crown which are similar to the provisions, in article 17 of the Town and Country Planning (Application of Subordinate Legislation to the Crown) Order 2006 (“the 2006 Order”), which modified the 1995 Order. Article 17 of the 2006 Order is consequently revoked.

These Regulations amend the Health and Safety Inquiries (Procedure) Regulations 1975. The amendments are consequential on amendments of the Health and Safety at Work etc. Act 1974 by the Employment Protection Act 1975 (c.71), which transferred to the Health and Safety Commission responsibilities for farm safety.

These Regulations revoke and replace the Building Regulations 2000 (S.I. 2000/2531) (“the 2000 Regulations”), and consolidate all subsequent amendments to those Regulations with minor amendments. The amendments include removing the requirement, where building work involves inserting insulation into a cavity wall, to submit along with a building notice a statement about the proposed insulating material. The Regulations also insert into Schedule 3 three new types of work that may be carried out under a self-certification scheme, and revise the list of bodies which are able to register persons for the purposes of self-certification. The three new types of work are the installation of cavity wall insulating material, replacement of roof coverings and installation of systems to produce electricity, heat or cooling by microgeneration or from renewable sources. The authorisation of this last category of work supports the implementation of article 14 of European Parliament and Council Directive 2009/28/EC on the promotion of the use of energy from renewable sources (OJ No. L140, 5.6.2009, p.16).
