This Order brings section 9 of the Housing and Planning Act 1986 into force on 13th May 1987. Section 9 provides a new ground (10A) for possession of a dwelling-house from a secure tenant under Part IV of the Housing Act 1985 (c. 68). It also amends the Land Compensation Act 1973 (c. 26) to make home loss payments available in certain circumstances where a secure tenant gives up possession of a dwelling-house.

These Regulations amend the Town and Country Planning (Environmental Impact Assessment)(England and Wales) Regulations 1999 in respect of England only, though regulation 22 inserts provisions that also apply in relation to Scotland, Wales and Northern Ireland.

This Order brings into force on 1st June 1996 provisions of the Housing and Planning Act 1986 which amend the Town and Country Planning (Scotland) Act 1972. They amend sections 53(2) and (4) (listed buildings) and 267(9) (local inquiries) of the 1972 Act. In consequence all the amendments to the 1972 Act made by the 1986 Act will be in force, apart from the inadvertent repeal of section 273(9) of the 1972 Act which has not been commenced.

This Order amends Parts 1, 24 and 25 of Schedule 2 to the Town and Country Planning (General Permitted Development) Order 1995 (“the 1995 Order”). Those Parts confer permitted development rights in respect of certain telecommunications development, including the erection of satellite antennas. Where such rights apply, no specific application for planning permission is needed.

This Order brings section 8 of the Housing and Planning Act 1986 into force on 5th April 1989. Section 8 provides for the provisions of Part V of the Housing Act 1985 (c. 68) (the right to buy) to continue to apply where a person ceases to be a secure tenant of a dwelling-house because the landlord has disposed of an interest in that dwelling-house in certain circumstances.

This section relates to a Minister’s costs in connection with statutory inquiries under—section 250(4) of the Local Government Act 1972 (general provisions as to costs of inquiries),section 96(5) of the Land Drainage Act 1976 (cost of inquiry under that Act),section 129(1)(d) of the Road Traffic Regulation Act 1984 (costs of inquiry under that Act),paragraph 9(2) of Schedule 22 to the Housing Act 1985 (c. 68) (costs of inquiry in connection with acquisition of land for clearance),any other statutory provision to which the section is applied by order of the Minister.
