Welsh Statutory Instrument
These Regulations amend the Building Regulations 2010 (“the 2010 Regulations”) as they apply in relation to Wales. The 2010 Regulations include requirements for automatic fire suppression systems to be installed in care homes for adults. Prior to the enactment of these Regulations the requirements for automatic fire suppression systems to be installed in care homes for children in Wales were provided in the Domestic Fire Safety (Wales) Measure 2011 (nawm 3) (“the 2011 Measure”). These Regulations will move the requirement in respect of care homes for children to the 2010 Regulations.

Section 1 of the Planning and Compulsory Purchase Act 2004 provides that there is to be a regional spatial strategy (“RSS”) for each region setting out the Secretary of State’s policies in relation to the development and use of land within the region. Each region’s RSS is reviewed by the regional planning body, which may prepare a draft revision of the RSS for submission to the Secretary of State. On receipt of a draft revision, the Secretary of State may decide that an examination in public should be held into the draft revision. Where he decides to do so, the examination must be held before a person appointed by the Secretary of State.

Article 2 of this Order brings into force on 30th June 2007, in relation to Wales, the following provisions of the Planning and Compulsory Purchase Act 2004—Section 42(1) and (5) to (9) (applications for planning permission and certain consents); andSchedule 9 so far as it gives effect to the repeal of section 76 of the Town and Country Planning Act 1990 (duty to draw attention to certain provisions for the benefit of the disabled).

Scottish Statutory Instrument

Regulation 2 amends the Planning Act 2008 (“the 2008 Act”). In section 14(1), it extends the categories of infrastructure project which are nationally significant for the purposes of the 2008 Act by adding to them, subject to section 29 of the 2008 Act (see section 14(2)), the construction or alteration of infrastructure for the transfer or storage of waste water, but it also limits these additional categories by limitations inserted in section 29. These limitations in section 29 provide criteria for determining whether any particular project for the construction or alteration of such infrastructure is to be treated as a nationally significant infrastructure project.

Welsh Statutory Instrument
Section 14A of the Social Services and Well-being (Wales) Act 2014 (“the 2014 Act”) requires local authorities and Local Health Boards to each prepare and publish a plan following the carrying out of an assessment of needs under section 14 of the 2014 Act (known as a “population assessment”). This plan (known as an “area plan”) must set out, amongst other things, the range and level of services the body proposes to provide, or arrange to be provided, in response to the population assessment.

The blight notice provisions in sections 149 to 171 of the Town and Country Planning Act 1990 (“the Act”) enable persons holding certain interests in categories of land (including land affected by certain planning and highway proposals) to require the appropriate authority to acquire their interest in the land. The categories of land are specified in Schedule 13 to the Act.
