This Order brings section 9 of the Housing and Planning Act 1986 into force on 13th May 1987. Section 9 provides a new ground (10A) for possession of a dwelling-house from a secure tenant under Part IV of the Housing Act 1985 (c. 68). It also amends the Land Compensation Act 1973 (c. 26) to make home loss payments available in certain circumstances where a secure tenant gives up possession of a dwelling-house.

This Order brings into force on 22nd September 1987 paragraph 8 of Schedule 5 to the Housing and Planning Act 1986. This amends section 62 of the Housing Associations Act 1985(c. 69) which provides for grants for affording tax relief to housing associations whose functions consist of or include providing or maintaining accommodation for letting. The effect of the amendment is to include the grant of a shared ownership lease (or in Scotland disposal under a shared ownership agreement) within the meaning of “letting”.

Schedule 14 to the Environment Act 1995 provides for the periodic review of the planning permissions for minerals development relating to a mining site (other than planning permission granted by development order). The first review date, in relation to a mining site, is determined in accordance with paragraph 3 of the Schedule, but this is subject to paragraph 3A(1) which gives the Secretary of State power, by order, to specify a different first review date.

Section 25 of the Planning Act 2008 (when read with section 14) provides for the construction or alteration of a railway to be, in certain circumstances, a nationally significant infrastructure project for the purposes of the Act. Article 2 of this Order designates Network Rail Infrastructure Limited and Network Rail (CTRL) Limited for the purposes of section 25.

This Order brings into force on two different dates section 57 of the Planning and Compensation Act 1991 insofar as it relates to paragraphs 3 and 9 and paragraph 11 of Schedule 10 to that Act. The Order applies only to Scotland. Paragraphs 3, 9 and 11 of Schedule 10 effect amendments to and insertions in the Town and Country Planning (Scotland) Act 1972.
