Such a scheme provides planning permission within the area covered by the scheme for development in accordance with the scheme without the need for specific application.

This Order is concerned with the further implementation in Scotland of Council Directive 85/337/EEC (OJ No. L175, 5.7.85, p. 40). It provides that no simplified planning zone scheme has effect to grant planning permission for development which requires environmental assessment. The Town and Country Planning (Simplified Planning Zones) (Scotland) Regulations 1995 (S.I. 1995/2043) provide that a planning authority shall not include such development in a simplified planning zone scheme.

Sections 21A -21E of, and Schedule 6A to, the Town and Country Planning (Scotland) Act 1972 (as inserted by section 26 of the Housing and Planning Act 1986) impose upon district and general planning authorities a duty to consider whether it would be desirable to establish simplified planning zones in their area and, where they decide that it would be beneficial to do so, to make schemes establishing such zones. These Regulations make further provision as to the procedures to be followed in the making or alteration of a simplified planning zone scheme.

These Regulations, which replace the Town and Country Planning (Special Enforcement Notices) (Scotland) Regulations 1984 following the commencement of the relevant provisions contained in the Planning and Compensation Act 1991, apply to special enforcement notices those provisions of the Town and Country Planning (Scotland) Act 1972 (as amended by the 1991 Act) which are specified in the Schedule to these Regulations subject to modification where appropriate. The Regulations make no substantive changes to the previous Regulations.

These Regulations amend the Town and Country Planning (Structure and Local Plans) Regulations 1982 to take into account the provisions of the Housing and Planning Act 1986. The Act allows simplified procedures to be followed where a local planning authority propose to alter, repeal or replace a local plan and it appears to them that the issues involved are not of sufficient importance to warrant the full procedure set out in section 12 of the Town and Country Planning Act 1971, and permits the Secretary of State to direct a local planning authority to consider modifying local plan proposals. The amendments made take account of these changes and also amend the 1982 Regulations to reflect the re-numbering of sections of the 1971 Act brought about by the 1986 Act.

These Regulations amend the form of tree preservation order contained in the Schedule to the Town and Country Planning (Tree Preservation Order) Regulations 1969 so as to enable local authorities, for the purposes of compensation and except where an application is referred to them under the Forestry Act 1967, to treat trees in woodlands which have an outstanding or special amenity value in the same way as all other such trees.

This Order amends the Town and Country Planning (Use Classes) Order 1987 (the principal Order). The principal Order specifies classes for the purposes of section 55(2)(f) of the Town and Country Planning Act 1990, which provides that a change of use of a building or other land does not involve development for the purposes of the Act if the new use and the former use are both within the same specified class.
