These Regulations make provision in respect of the notification and publication requirements introduced by the Historic Environment Scotland Act 2014, where a listed building is either included in or excluded from the list of buildings of special architectural or historic interest compiled or approved under section 1 of the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 or where an entry relating to a building in that list is amended.

This Order makes saving provisions in relation to the changes made to the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 (“the Listed Buildings Act”) on 1stDecember 2011 by section 20(3) and section56 of and the Schedule to the Planning etc (Scotland) Act 2006. Article 2 preserves the provisions of section 16 of the Listed Buildings Act (which require conditions relating to the duration of the consent to be imposed when granting listed building consent) as they had effect immediately before 1st December 2011 in respect of a listed building consent granted before that date. Article 3 preserves the right to be heard during the process for determining an appeal under section 18 or 35 of the Listed Buildings Act where notice of appeal is given before 1stDecember 2011.

Scottish Statutory Instrument
Section 93 of the Planning and Compulsory Purchase Act 2004 amended the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 by inserting new section 73B. This section makes provision for urgent applications for works to buildings on Crown land which are listed or which are in conservation areas and provides for such applications to be made directly to the Scottish Ministers.

These Regulations amend the Building Regulations 2010 (S.I. 2010/2214, as amended by S.I. 2011/1515, S.I. 2011/3058, S.I. 2012/809, S.I. 2012/3119, S.I. 2013/10, S.I. 2013/181, S.I. 2013/1105, S.I. 2013/1959, S.I. 2014/579, S.I. 2015/767 and S.I. 2016/285) (“the Building Regulations”). They implement Article 8 (in-building physical infrastructure for high-speed electronic communications networks) of Directive 2014/61/EU of the European Parliament and of the Council on measures to reduce the cost of deploying high-speed electronic communications networks (OJ No L 155, 23.5.2014, p.1) (“Directive 2014/61/EU”).
