The Health and Safety at Work etc. Act 1974 (Application to Environmentally Hazardous Substances) Regulations 2002 (“the 2002 Regulations”) extend the reference to dangerous substances in section 1(1)(c) of the Health and Safety at Work etc. Act 1974 (“the 1974 Act”) to include environmentally hazardous substances. The purpose of the 2002 Regulations is to enable regulations to be made under section 15 of the 1974 Act to implement the Directives referred to in regulation 2 of the 2002 Regulations.

These Regulations amend the Health and Safety (Fees) Regulations 2007. They provide for the charging of fees for work by the Health and Safety Executive in relation to an “assessment agreement” and a “design proposal”, as defined in the amending provisions, for nuclear installations.

This Order, made under the Scotland Act 1998 (c. 46), provides for certain functions of a Minister of the Crown under the Electricity Act 1989 (c. 29) (“the Electricity Act”), so far as they are exercisable by that Minister in or as regards Scotland, to be exercisable by the Scottish Ministers instead of by the Minister concerned. This Order consolidates in one instrument the devolution of functions under section 36 of the Electricity Act (consents to construct, extend or operate electricity generating stations) by revoking the devolution of those functions effected in the Scotland Act 1998 (Transfer of Functions to the Scottish Ministers etc.) Order 1999 (SI 1999/1750) and by then, on the following day, re-devolving those functions to the Scottish Ministers. The other functions transferred by this Order relate to the consideration of applications under section 36 of the Electricity Act where the proposed generating station is not within the area of a planning authority, and consultation with the Scottish Environment Protection Agency (“SEPA”) in relation to generating stations powered by water.

These Regulations make the Office of Rail Regulation (“ORR”) responsible for the enforcement of health and safety law in relation to the operation of railways, tramways and certain other systems of guided transport in place of the Health and Safety Executive (“HSE”), (i.e. the enforcement of Part 1 of the Health and Safety at Work etc. Act 1974 (“the 1974 Act”), regulations made under section 15 and certain “existing statutory provisions” as defined in section 53 of the 1974 Act, as extended in scope by section 117 of the Railways Act 1993). Thus the ORR will be the “enforcing authority” for these purposes within the meaning of section 18(7) of the 1974 Act, (regulation 3).

These Regulations amend the Asbestos (Prohibitions) Regulations 1992, as amended, by the insertion of a definition of the words “intentionally been added” in regulation 2. The definition includes an evidential presumption, which is rebuttable if evidence to the contrary is adduced in any proceedings.

These Regulations amend the Health and Safety (Fees) Regulations 1999 (S.I. 1999/645) so as to insert provisions (regulation 2) which fix or determine the fees payable by specified persons in the offshore, rail and gas industries for the performance by the Executive of the functions specified in those provisions.
