This Order provides for the setting up as from the 1st April 1999 of a fund with public money under the Government Trading Funds Act 1973 for the operations of the National Health Services Estate Management and Health Building Agency. The fund is to be known as the NHS Estates Trading Fund.

These Regulations further amend the Building (Approved Inspectors etc.) Regulations 1985 (S.I. 1985/1066) (“the 1985 Regulations”) and provide that, where the Secretary of State has designated one or more bodies under the Building Act 1984 and the 1985 Regulations for the purpose of approving inspectors, all applications for approved inspector status shall be made to a designated body. Hitherto, bodies corporate wishing to be approved inspectors were required to apply to the Secretary of State, whilst individuals wishing to be approved inspectors were required to apply to a designated body.

These Regulations make further amendments to the Building Standards (Scotland) Regulations 1990 (the “1990 Regulations”) and the Building (Procedure) (Scotland) Regulations 1981. The amendments take account of the evolution of building practices in the areas of fire prevention and building ventilation, and give effect to some provisions of Directive 93/76/EEC (to limit carbon dioxide emissions by improving energy efficiency).

These Regulations amend the Building (Approved Inspectors etc.) Regulation 1985 (the principal regulations) as a consequence of the Deregulation (Building) (Initial Notices and Final Certificates) Order 1996. That Order, amongst other things, provides for an amendment to an initial notice by way of an amendment notice.

These Regulations make further amendments to the Building Standards (Scotland) Regulations 1990. Regulation 25 is amended to apply the requirement to provide adequate sanitary facilities to all buildings except school premises, for which provision is made elsewhere. A new Schedule 1 is substituted to clarify the descriptions of some classes of exempted buildings and to expand on the exceptions to certain classes of exempted buildings, principally to ensure that buildings on land which has harmful or dangerous substances within its boundaries remain subject to the Regulations. A new Schedule 2 is substituted to include 2 further categories of fixtures not requiring a warrant, and to clarify the description of some fixtures which may be replaced. Schedule 5 is amended to clarify the rules of measurement of (a) the area of a room and of (b) height and depth (i) of a storey of a building and (ii) in circumstances where the ground is not level. The Regulations amend the definition of “Technical Standards” to allow the substitution of pages dated November 1996 in parts A, B, G, M and P of the Technical Standards. These substitutions reflect the changes made by these Regulations, update the British Standards references in parts B and P and make other minor drafting and updating changes.

Part II of the Building Act 1984 (“The 1984 Act”) makes provision for private sector building control through Approved Inspectors. Part II provides for the giving of initial notices by an Approved Inspector which if accepted by the relevant local authority removes the work to which the notice relates from supervision by the authority. Such a notice may be cancelled or withdrawn but may not be amended.

Scottish Statutory Instrument
These Regulations make further amendments to the Building Standards (Scotland) Regulations 1990 (the “1990 Regulations”). The amendments deal mainly with Part D (Structural Fire Precautions), Part E (Means of Escape from Fire, Facilities for Fire-fighting and Means of Warning of Fire), Part J (Conservation of Fuel and Power), Part M (Drainage and Sanitary Facilities) and with minor amendments to other Parts of the Technical Standards for compliance with the Building Standards (Scotland) Regulations 1990.

These Regulations are made under section 5 of, and the Schedule to, the Act and make provision in relation to the definition of a serviced plot of land and registers kept under the Act.

The Building Regulations 2000 (S.I.2000/2531 as amended by S.I. 2000/3335, S.I. 2002/440, S.I. 2002/2871 and S.I. 2003/2692), “the principal Regulations”, impose requirements on people carrying out certain building operations. The Building (Amendment) (No.2) Regulations 2004 (“the No. 2 Regulations”) made certain amendments with respect to electrical safety. These Regulations revoke the No. 2 Regulations, and incorporate the same amendments with some minor alterations and additional amendments to the principal Regulations. In addition to minor and drafting amendments the following changes of substance to the principal Regulations are made.
