United Kingdom Statutory Instrument
The Building (Approved Inspectors etc.) Regulations 2000 (S.I. 2000/2532 amended by S.I. 2001/3336) are principally concerned with the inspection of plans and of building work by approved inspectors in place of local authorities (as provided for in the Building Act 1984). These Regulations amend the 2000 Regulations in consequence of the amendments made to the Building Regulations 2000 (S.I. 2000/2531 amended by S.I. 2001/3335 and 2002/440) by the Building (Amendment) (No. 2) Regulations 2002 (S.I. 2002/2871) and in particular the substitution of Part E of Schedule 1 (resistance to the passage of sound).

Northern Ireland Statutory Rule
These Regulations amend the Planning (Listed Buildings) Regulations (Northern Ireland) 2015 (“the Listed Buildings Regulations 2015”) as a consequence of the Departments (Transfer of Functions) Order (Northern Ireland) 2016. These Regulations take account of the restructuring of Government Departments and reflect the consequent revised roles and responsibilities of planning authorities and statutory consultees in the listed building process of the planning system.

These regulations bring into force the provisions of the Self-build and Custom Housebuilding Act 2015 (c.17) that are not yet in force on 1st April 2016. Section 6 of the Act commenced on Royal Assent. The remaining provisions are sections 1 to 5 of, and the Schedule to, the Act. The Act places duties on certain public authorities to keep a register of individuals and associations of individuals who are seeking to acquire serviced plots of land in the authority’s area in order to bring forward self-build and custom housebuilding projects, and to have regard to that register in carrying out their planning and other functions. The Schedule to the Act enables the making of Regulations that make provision in relation to registers.

These Regulations further amend the Building (Procedure) (Scotland) Regulations 1981. The principal changes are as follows:the updating of references to the building standards regulations to take account of the Building Standards (Scotland) Regulations 1990 (SI 1990/2179) and their supporting volume, the Technical Standards (ISBN 0-11-494105-X), and consequential amendments (regulations 3, 6, 7, 14, 15(a) and (b));an amendment to clarify that extensions to warrants may only be granted during the life of the warrant (regulation 4);an amendment concerning the 14 days allowed to local authorities to consider an application for a certificate of completion to clarify that this period starts from the date on which the local authority receive the application (regulation 5);an amendment to allow local authorities to grant a relaxation of the building standards regulations as soon as all parties concerned have indicated they are content with the draft direction (regulation 8);an amendment giving local authorities discretion as to the form in which plans are retained for record purposes (regulation 13);amendment to Schedule 1 to the principal Regulationsto require more information with applications for demolition warrants;to allow local authorities more discretion concerning the acceptance of simpler plans; andto oblige local authorities to accept plans drawn on polyester film (regulation 15(d), (f) and (g)).

These Regulations prescribe Welsh versions of—forms of notification to be sent to the applicant in connection with an application for listed building consent, conservation area consent or for the variation or discharge of conditions subject to which listed building consent or conservation area consent has been granted (regulation 2 and Schedule 1); andforms of certificate and notice to be used in connection with the applications described in paragraph (a) above and appeals to the Secretary of State pursuant to paragraph 8 or paragraph 9 of Schedule 11 to the Town and Country Planning Act 1971 (regulation 3 and Schedule 2); andforms of notification to be used to inform an owner or occupier that a building has become listed or has ceased to be listed (regulation 4 and Schedule 3).

These Regulations make certain amendments to the Building (Procedure) (Scotland) Regulations 1981. The principal change is the amendment of regulation 7 which provides for the exclusion from liability for building warrant fees of applications in respect of alterations or extensions of buildings to provide facilities for disabled persons.

These Regulations amend the Energy Performance of Buildings (England and Wales) Regulations 2012 (S.I. 2012/3118, as amended by S.I. 2013/10, S.I. 2013/181, S.I. 2013/603, S.I. 2014/880 and S.I. 2015/609) (“the principal Regulations”) to supplement the implementation by those Regulations of Article 27 (penalties) of Directive 2010/31/EU of the European Parliament and of the Council on the energy performance of buildings (recast) (OJ No L 153, 18.6.2010, p. 13).

These Regulations amend the Energy Performance of Buildings (England and Wales) Regulations 2012 (“the Principal Regulations”) which enacted, in part, Directive 2010/31/EU of the European Parliament and of the Council of 19 May 2010 on the energy performance of buildings (recast) (“the Directive”).
