Article 2 of this Order amends the Planning Act 2008 (c. 29) (“the Act”) in respect of nationally significant infrastructure projects (“NSIP”) in the field of water to introduce a new category of NSIP and amend the thresholds of the existing categories of NSIP.

The Town and Country Planning (Environmental Impact Assessment) (England and Wales) Regulations 1999 (S.I.1999/293) (“the 1999 regulations”) implemented, in England and Wales, Council Directive 85/337/EEC (“the EIA Directive”) on the assessment of the effects of certain public and private projects on the environment (O.J. No. L175, 5.7.1985, p.40) as amended by Council Directive 97/11/EC (O.J. No. L73, 14.3.1997, p.5). The EIA Directive was also amended by Council Directive 2003/35/EC (O.J. No. L156, 25.6.2003, p.17). The Town and Country Planning (Environmental Impact Assessment)(England and Wales)(Amendment) Regulations 2000 (S.I. 2000/2867) (“the 2000 Regulations”) implemented the Directives in respect of ROMP applications (applications made to mineral planning authorities to determine the conditions to which a mineral planning permission is subject under Schedule 2 to the Planning and Compensation Act 1991 (c.34) and Schedules 13 and 14 to the Environment Act 1995 (c.25) made after the commencement of the 2000 Regulations (15 November 2000). The Town and Country Planning (Environmental Impact Assessment) (Minerals Permissions and Amendment)(England) Regulations 2008 (S.I. 2008/1556) (“the 2008 Regulations”) applied the 1999 Regulations, with modifications, to ROMP applications made before 15 November 2000 which were undetermined on 22 July 2008 and contained provisions applying to all ROMP applications.

The Town and Country Planning (Trees) Regulations 1999 (“the 1999 Regulations”) make provision, among other things, for the form of tree preservation orders and for applications for consent to carry out work on trees subject to an order.

Scottish Statutory Instrument
These Rules amend the Town and Country Planning (Inquiries Procedure) (Scotland) Rules 1997 and the Town and Country Planning Appeals (Determination by Appointed Person) (Inquiries Procedure) (Scotland) Rules 1997. The amendments made by rules2 and 3 provide that those Rules do not apply to inquiries held in connection with the consideration of applications or appeals under the Planning (Listed Buildings and Conservation Areas) (Scotland) Act 1997 whose procedure is regulated by the Town and Country Planning (Appeals) (Scotland) Regulations 2008.

Section 294 of the Town and Country Planning Act 1990 empowers local planning authorities (with the consent of the Crown) to issue special enforcement notices in respect of development carried out on Crown land by persons such as trespassers at a time when there is no private right to occupy the land. Section 295(5) applies to special enforcement notices certain of the provisions of sections 174, 175 and 176 of the Town and Country Planning Act 1990 relating to enforcement notices issued in respect of breaches of planning control and empowers the Secretary of State to apply other provisions of the 1990 Act with modifications. These Regulations apply to special enforcement notices certain provisions of the 1990 Act specified in the Schedule and adapt those provisions to such notices. They supersede the Town and Country Planning (Special Enforcement Notices) Regulations 1984.

Northern Ireland Statutory Rule
This Order is made under section 67(1) of the Local Government Act (Northern Ireland) 2014 and specifies certain persons and bodies (the functions of which are exercisable in the district of a council) as community planning partners of that council.

These Rules set out the procedure to be followed in connection with local inquiries in England held by inspectors appointed by the Secretary of State to determine appeals against—enforcement notices under section 174 of the Town and Country Planning Act 1990;the refusal or non-determination of an application for a certificate of lawful use or development under section 195 of that Act; andlisted building enforcement notices and conservation area enforcement notices under section 39 of the Planning (Listed Buildings and Conservation Areas) Act 1990.

Scottish Statutory Instrument
These Regulations are made in exercise of the powers in paragraph 1(1) and (3) of schedule 2 of the European Union (Withdrawal) Act 2018 (c.16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular under section 8(2)(d) and (g) of that Act) arising from the withdrawal of the United Kingdom from the European Union.

Northern Ireland Statutory Rule
The Department for Infrastructure makes the following Regulations in exercise of the powers conferred by section 2(2) of the European Communities Act 1972 and also, where appropriate, domestic legislation, in order to make minor miscellaneous amendments to update the provisions set out in them to allow the amended provision to operate appropriately.
