The Planning Act 2008 (“the Act) establishes the Infrastructure Planning Commission (“the IPC”) and provides for the granting of development consent for certain types of nationally significant infrastructure projects. Part 6 of the Act sets out the procedure for examining the majority of applications for development consent.

The Town and Country Planning (Environmental Impact Assessment) (England and Wales) Regulations 1999 (S.I. 1999/293) as amended by the Town and Country Planning (Environmental Impact Assessment) (England and Wales) (Amendment) Regulations (S.I. 2000/2867) and the Town and Country Planning (Environmental Impact Assessment) (Amendment) Regulations 2006 (S.I. 2006/3295) implemented, in England and Wales, Council Directive 85/337/EEC on the assessment of the effects of certain public and private projects on the environment (O.J. No. L175, 5.7.1985, p.40), as amended by Council Directive 97/11/EC (O.J. No. L73, 14.3.1997, p.5) and Council Directive 2003/35/EC (O.J.No. L156, 25.6.2003, p.17), in relation to applications to mineral planning authorities to determine the conditions to which a mineral planning permission is subject under Schedule 2 to the Planning and Compensation Act 1991 and Schedules 13 and 14 to the Environment Act 1995 (“ROMP applications”).

Section 2A of the Town and Country Planning Act 1990 (c.8) (inserted by section 31 of the Greater London Authority Act 2007 (c.8)) gives the Mayor of London power to direct that applications for planning permission of potential strategic importance (“PSI applications”) must be determined by him in place of the local planning authority. Section 74(1B) of the 1990 Act (inserted by section 344 of the Greater London Authority Act 1999 (c.29)) enables provision to be made in a development order for enabling the Mayor to direct the local planning authority to refuse such an application.

This Order makes provisions that are consequential on the Planning etc. (Scotland) Act 2006 (“the 2006 Act”). The Order extends to Scotland only. Sections 33 to 49 of the 2006 Act provide for business improvement district arrangements (“BID arrangements”), which local authorities are enabled to make with respect to an area comprising all or part of the local authority area. BID arrangements require to be approved by a ballot. The purpose of this Order is to provide for a levy (“BID levy”) that is imposed in the business improvement district.
