These Regulations further amend the Building Regulations 1991 (S.I. 1991/2768). The amendments—insert a new regulation 13A providing for regularisation certificates in relation to unauthorised work (Regulation 2(3));insert a new regulation 14A providing for energy rating of new dwellings (regulation 2(4));revoke Requirement A4 relating to disproportionate collapse (regulation 2(5)(a)) and make a consequential amendment (regulation 2(2)(b));substitute the limits on application of Requirement F1 relating to means of ventilation (regulation 2(5)(b)); andsubstitute Requirement L1 relating to conservation of fuel and power (regulation 2(5)(c)) and apply that Requirement in certain cases of material change of use (regulation 2(2)(a)).

These Regulations make provision for the conduct of referendums held under paragraph 16 of Schedule 4B to the Town and Country Planning Act 1990 (“the 1990 Act”). These Regulations only apply in relation to England. The referendums will relate to the question of whether a neighbourhood plan, neighbourhood development order or a community right to build order is approved.

These Regulations amend the Building Regulations 1991 so as to require the deposit with the local authority of two additional sets of plans demonstrating compliance with fire safety requirements except where the proposed building work relates to the erection etc of a dwelling-house or flat.

These Regulations further amend the Building Regulations 1991 (S.I. 1991/2768) to substitute a revised Regulation 7, which is set out in Regulation 4 of these Regulations. The revised Regulation 7 retains the obligation to carry out building work using materials which are appropriate to the particular circumstances which apply, and for those materials to be used in a workmanlike manner. In addition, it provides that materials used in building work must be adequately mixed or prepared, and that they must be used so as adequately to perform the functions for which they are designed. The revised Regulation 7 no longer refers to forms of product approval: guidance on materials and workmanship is given in the approved document referred to below.

Article 2 of this Order brings into force on 28th September 2004, in relation to England, the following provisions of the Planning and Compulsory Purchase Act 2004 (“the Act”) in so far as they are not already in force –Part 1 (regional functions);Part 2 (local development);Section 38 (reference to development plan in any enactment);Section 39 (sustainable development);Section 113 (validity of strategies, plans and documents);Section 114 so far as it relates to Part 2 of the Act (examination of a document or plan is a statutory inquiry);Section 119(1) (transitional provisions);Schedule 6, paragraphs 1, 8 to 13, 15, 16(1) and (2), 17 to 19, 21, 22 and 25 (amendments of the planning Acts);Schedule 7, paragraphs 2, 3, 6, 8, 11(1) to (3), 16, 17, 19(2), 22 and 23 (amendments of other enactments);Schedule 8 (transitional provisions for Parts 1 and 2 of the Act) andSchedule 9, so far as it gives effect to the repeals specified in Part 1 of Schedule 1 to this Order.

Scottish Statutory Instrument
This Order preserves Part 2 of the Town and Country Planning (Scotland) Act 1997 (“the 1997 Act”) in full force and effect notwithstanding the commencement for certain purposes of section 2 of the Planning etc. (Scotland) Act 2006 (“the 2006 Act”). Section 2 of the 2006 Act substitutes a new Part 2 for Part 2 of the 1997 Act.

United Kingdom Statutory Instrument
These Regulations are made under the Building Act 1984 (“the Act”). They revoke and replace with amendments the Building Regulations 1991 (“the 1991 Regulations”) and consolidate all subsequent amendments to those Regulations. They impose requirements on people carrying out certain building operations.
