This Order amends the Environmentally Sensitive Areas (Upper Thames Tributaries) Designation Order 1994 (“the principal Order”) as amended, which designated an area in the Upper Thames Tributaries as an environmentally sensitive area, in implementation of Council Regulation (EEC) No. 2078/92 (OJ No. L215, 30.7.92, p. 85) on agricultural production methods compatible with the requirements of protection of the environment and the maintenance of the countryside, as amended by Council Regulation (EC) No. 2772/95 (OJ No. L288, 1.12.95, p. 35) as in turn rectified by Council Regulation (EC) No. 1962/96 (OJ No. L259, 12.10.96).

Northern Ireland Statutory Rule
These Regulations amend the planning provisions in the Conservation (Natural Habitats, etc) Regulations (NI) 1995 to ensure they will operate fully and effectively when councils assume their new “competent authority” planning role from 1st April 2015.

This Order amends the Town and Country Planning General Development Order 1988 (the 1988 Order). Under the Water Act 1989 (c. 15) the functions of water authorities are transferred to the National Rivers Authority and water and sewerage undertakers. This Order therefore makes the National Rivers Authority the consultee for the purposes of article 18 of the 1988 Order (consultations before the grant of planning permission) rather than the water authority concerned (article 2(2)) and transfers the permitted development rights of water authorities to the National Rivers Authority and the water and sewerage undertakers (article 2(1), (3), (4) and (5)). It also makes some minor consequential drafting amendments.

These Regulations amend the Information as to Provision of Education (England) Regulations 2008 (S.I. 2008/4), which prescribe the information that local authorities are required each year to provide to the Secretary of State in relation to the provision of primary and secondary education in their area. These Regulations change the date by which information must be provided to the Secretary of State from 27th August to 10th August and extend the requirement to provide certain information to pupil planning areas where local authorities divide their area for the purposes of assessing current and future pupil demand and school capacity. These Regulations additionally require local authorities to provide forecasts of the total capacity of primary and secondary schools in each of their pupil planning areas, and to provide the admission numbers in schools for each age group and the total such numbers within each pupil planning area. Where a local authority has changed their pupil planning areas from the previous year, they must inform the Secretary of State of the changes.

This Order amends the Town and Country Planning General Development Order 1988. The main changes are—an amendment to article 10 of the 1988 Order, to provide for applications to be made tothe authority which will determine the application (previously applications which fell to be determined by a county planning authority had to be made to the district planning authority, which passed the application on to the county)—this change has necessitated consequential amendments to articles 15, 21, 27, 29 of, and Schedule 3 to, the 1988 Order (articles 2, 3, 5, 6, 7 and 11);the extension of consultation requirements to—the construction of access to a road in respect of which a toll order is in force;development in, likely to affect or, in certain cases, within two kilometres of, an area of special scientific interest; anddevelopment for the purposes of fish farming;the restriction of permitted development rights in an area of special scientific interest if the use of the land is for certain motoring activities, clay pigeon shooting, or any war game (article 8);the substitution of Part 6 of Schedule 2 to the 1988 Order (agricultural buildings and operations). Part 6 as substituted gives permitted development rights (where the development is, or minerals are, as the case may be, reasonably necessary for the purposes of agriculture) in relation to—certain building works and excavation or engineering operations on agricultural units of 5 hectares or more in area (Class A);the extension or alteration of agricultural buildings, the installation of certain plant and machinery, the provision of sewers etc, and certain other works, on agricultural units of not less than 0.4 but less than 5 hectares in area (Class B); andthe winning and working of minerals on certain land (Class C);
