This instrument amends the Town and Country Planning (General Permitted Development) (England) Order 2015 (S.I. 2015/596) (“the GPDO”). The GPDO provides, for the purposes of section 59 of the Town and Country Planning Act 1990 (c. 8), for the granting of permission for certain classes of development without the requirement for a planning application to be made under Part 3 of that Act.

Sections 293B and 293C of the Town and Country Planning Act 1990 (c. 8) (as inserted by section 109 of the Levelling-up and Regeneration Act 2023 (c. 55)) provide a route for applications for planning permission for Crown development in England where the development is considered to be of national importance, and where it is also necessary that the development be carried out as a matter of urgency.

Northern Ireland Statutory Rule
These Regulations amend the Planning (Fees) Regulations (Northern Ireland) 2015 which prescribe the fee payable in respect of applications made under the Planning Act (Northern Ireland) 2011. The Regulations increase planning fees by approximately 2.1% overall. Regulation 3 revokes the Planning (Fees) (Amendment) Regulations (Northern Ireland) 2024.
