These Regulations implement the land-use planning obligations (articles 13 and 15) in Directive 2012/18/EU of the European Parliament and of the Council on the control of major-accident hazards involving dangerous substances (O.J. 197, 24.7.2012, p.1) (“the Seveso III Directive”).

These Regulations bring into force section 181 of the Housing and Planning Act 2016 (c. 22) (“the Act”) insofar as it is not already in force. Section 181 of the Act inserts new section 14D into the Acquisition of Land Act 1981 (c. 67) (“the 1981 Act”). This enables the Welsh Ministers as confirming authority to appoint an inspector to act instead of them in relation to the confirmation of a compulsory purchase order to which section 13A of the 1981 Act applies.

Northern Ireland Statutory Rule
These Regulations consolidate with amendments the provisions of the Planning (Environmental Impact Assessment) Regulations (Northern Ireland) 1999 (“the 1999 Regulations”) and subsequent amending regulations. The 1999 Regulations consolidated and updated earlier regulations which implemented Council Directive 85/337/EEC O.J. No. L. 175, 5.7.1985, p 40 (“the EIA Directive”) on the assessment of the effects of certain public and private projects on the environment. The EIA Directive was amended by Directive 97/11/EC, (O.J. No. L 73, 14.3.1997, p.5); Directive 2003/35/EC, (O.J. No. L 156, 25.6.2003, p.17); and Directive 2009/31/EC, (O.J. No. 140, 5.6.2009, p.114).
