Northern Ireland Statutory Rule
The Construction Contracts (Northern Ireland) Order 1997 (“the Order”) makes provision as regards the terms of construction contracts. Article 5(1A) confers power to exclude descriptions of contracts from the operation of any or all of the provisions of the 1997 Order and this Order excludes a type of contract from the operation of one such provision.

This Order gives effect to proposals submitted by the Construction Industry Training Board to the Department for the Economy for the imposition of a further levy upon employers in the construction industry for the purpose of raising money towards the expenses of the Board.

These Regulations are made in exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2018 (c.16) in order to address failures of retained EU law to operate effectively and other deficiencies (in particular paragraphs (a), (b), (c), (f) and (g) of section 8(2)) arising from the withdrawal of the UK from the European Union.

United Kingdom Statutory Instrument
These Regulations amend the Income Tax (Construction Industry Scheme) Regulations 2005 (S.I. 2005/2045) (the “2005 Regulations”) to enable Her Majesty’s Revenue and Customs (“HMRC”) to require security or further security for the payment of sums in respect of which a contractor is, or may be, accountable to HMRC under either section 61 of the Finance Act 2004 (ch. 12) (“FA 2004”) or the 2005 Regulations.

Northern Ireland Statutory Rule
These Regulations amend the Construction Plant and Equipment (Noise Emission) Regulations (Northern Ireland) 1987, S.R. 1987 No. 328 as amended by S.R. 1990 No. 102 (“the principal Regulations”), which implement as respects Northern Ireland Council Directives No. 84/532/EEC, No. 84/533/EEC, No. 84/534/EEC, No. 84/535/EEC, No. 84/536/EEC and No. 84/537/EEC of 17th September 1984 (OJ No. L300, 19.11.84, pp. 111-170) as amended by Commission Directives No. 85/406/EEC, No. 85/407/EEC, No. 85/408/EEC and No. 85/409/EEC (OJ No. L233, 30.8.85, pp. 11-20) and also Council Directive No. 87/405/EEC (OJ No. L220, 8.8.87, p. 60). The principal Regulations apply to construction plant and equipment as defined in the Regulations, ie compressors, tower cranes, welding generators, power generators and powered hand-held concrete-breakers and picks designed for use in or about building or civil engineering operations.

Welsh Statutory Instrument
So far as extending to England and Wales, this Order commences provisions in Part 8 of the Local Democracy, Economic Development and Construction Act 2009 (c. 20) (“the 2009 Act”) in relation to construction contracts which relate to the carrying out of construction operations in Wales. It does not commence such provisions in respect of other construction contracts which are being commenced by separate commencement orders.
