These Regulations amend the Scheme for Construction Contracts in Northern Ireland Regulations (Northern Ireland) 1999 (“the Scheme”), in part to reflect changes made to the relevant primary legislation, the Construction Contracts (Northern Ireland) Order 1997: SI 1997 No 274 (N.I. 1) (“the 1997 Order”), by the Construction Contracts (Amendment) Act (Northern Ireland) 2011 c.4.

Northern Ireland Statutory Rule
This Order amends the Industrial Training Levy (Construction Industry) Order (Northern Ireland) 1996 (“the 1996 Order”) by providing that from 28th February 1997 in relation to any employer engaged wholly or mainly in electrical construction, installation, maintenance or repair work nothing in the 1996 Order:shall be taken to impose a levy upon such an employer in respect of any period falling on or after that date; andshall require such an employer to pay an amount in respect of that period by virtue of an assessment notice served in connection with the levy.

So far as extending to England and Wales, this Order partially commences a provision of Part 8 of the Local Democracy, Economic Development and Construction Act 2009 (“the 2009 Act”). Part 8 relates to construction contracts. It does not commence this provision in respect of contracts relating to construction operations in Wales, however. This Order brings into force, on the day after it is made, section 138 of the 2009 Act - the provision concerning the Secretary of State’s power to disapply (as regards specified types of construction contract) the operation of any or all of the provisions of Part 2 of the Housing Grants, Construction and Regeneration Act 2006. It commences this provision to the extent of enabling the Secretary of State to exercise this power.

This Order gives effect to proposals of the Engineering Construction Industry Training Board which were submitted to the Secretary of State. The proposals are for the imposition of a levy on employers in the engineering construction industry for the purpose of raising money towards meeting the expenses of the Board. The levy is raised in respect of those who carry out engineering construction work on site. No levy is raised in respect of those who run the employer’s business through its head office.

This Order gives effect to proposals of the Engineering Construction Industry Training Board which were submitted to the Secretary of State. The proposals are for the imposition of a levy on employers in the engineering construction industry for the purpose of raising money towards meeting the expenses of the Board. The Order also imposes a levy on employers who are not mainly engaged in engineering construction activities but are engaged in any related or administrative activities of a kind to which paragraph 1(c) of Schedule 1 to the Industrial Training (Engineering Board) Order 1964 (as amended by the Industrial Training (Engineering Construction Board) Order 1991) applies; and for those employers the levy will be imposed only in respect of such related or administrative activities.
